How ILLERTATE Can Sign, Help

Default How ILLERTATE Can Sign, Help

Experts help; I don’t know the answer for this:

One of my friend who is US Green Card holder wants her mother to come on Visitor visa to USA for 2 months. She is 65 years old and is ILLERATE; she does not know how to sign Visitor Visa, application, as she does not write even ABCD or any language. She is from India. Visitor visa has no option for Thumb impression. On her passport she has no signature, she has Thumb impression and in India one can Sign or put his/her Thumb impression on any government of India documents. But this is US matter and not related to India. What are her options? Can she never apply for US Visitor visa? If you know any option please help.

If your friend hasn't realised this already, he/she should contact the US consulate where he/she is making the application and explain that the mother, the applicant is illiterate.

A US Consulate official should be able to give you a reply about how and whether the mother can apply for a visitor visa seeing that she is illiterate.

It is most common for illiterate US citizens to sign with an "X".
That said some agencies require that the "X" be completed in front of
a witness and others do not. I would contact the agency who will
issue the visa and ask them directly what she needs to do.

What I can assure you is that this has happened before and it wont
keep her out of the country

My friend sent an Email to New Delhi US consulate regarding what should be done to sign Visitor Visa form if she is ILLERATE and what is the alternative for that.

They have replied " We do not have any instuctions in this regard"

Please help can I find some info from US department of Justice any email phone # or the agency to be contacted in US to get the info.

How about teaching her how to sign her name?

No body to teach her, India is not like US where any one can go to attend classes even if he/she is 50 yers above, US is much better.In India she can not find any classes.
No school will admit her and becase of her age it is difficult for her to learn to Sign her name, becase first she has to learn any language.

She tried earlier to just write X or I but with in few days she forget how she wrote X

Can she just put in the Signature coulumn I ?, becase I will be easy for her if it is poosible please help she can be trained to write I or !

But on her Indian Passport where the Signature Appears she has her Thumb Impression, will it also create problems? In India many have Thumb immprssion on Passports.

If she will forget how to sign an 'X' the US might not be the place for her!
How can she survive here? Or even find work?

The US Embassy in Delhi is just trying to be cute. It is standard practice in US for illiterates to make the X. She can make the X and she will hav eto make the X again in front of the US consulate officer, if asked to do so. That basically means that she is stating under oath that all the information in the application is true. Obviously, she will need a trnaslator for the interview.

Some suggestions:

Call the State Department phone number for public inquiries about visa
services: 202-663-1225

There is also an email address for State Department inquiries:
'[email protected]'

You could also call your Congressperson -- the local office, and ask to
speak with someone in charge of immigration inquiries. See

Dear Sir/Madam,
You are Correct that US is not the place for her if she can not sign X, She is not trying to come for Survival or to find work in US. I never wrote that she is coming to US to find work, Just I asked that she needs to Visit his Son who is in US and for that she has to apply for Visitor Visa to Visit US, in her old age if she can see or Visit US or other side of the world what is the problem, If you have any objection for her visit to US I am sorry for my post.

I am sorry, I welcome everybody - no exception!
My opinion is everybody should be able to go anywhere.
Visas are part of bureaucracy and we can live well without them.

Unfortunately, she must be literate in order to get a tourist visa.

For persons over 15 years of age, illiteracy is among the grounds of
inadmissibility, even as a tourist.

how much % are you sure?
Would you be kind enough to let us know, where it is written in US law related to Visitors that illiteracy is among the grounds of
inadmissibility, even as a tourist.,
I searched the many US law sites but could not find answer that Illetrate is not eligible for Visitor Visa.
I have seen the many from India who can not speake English language and have visited in past.
But this case is uniqe that she can not Sign, if an Illetratre person is among the grounds of inadmissibilty, is it not discrimination?

Not speaking English is OK. But anybody over 15 must be literate in at
least one language (presumably his native language) in order to be
admissible.

It took me a while to figure it out. 9 FAM 41.103 N4.1 states:

    >> guardian. If the alien has no parent or guardian, then the Form DS-156

I believe there also is a basis for this in the INA, but I couldn't find
it.

Whether or not this is discriminatory is moot. Immigration law, by nature
and by design, is discriminatory. It discriminates against non-citizens,
and then against people with HIV or who may have at some point been
criminals but paid their debt to society. It discriminates against the
poor and the uneducated, too.

And all of that is generally accepted as justified because immigration
law is designed to protect the interests of the United States, not the
interest of the people seeking admission.
