Not true. On indictment it's 10 years. It's the maximum POSSIBLE sentence, and there is no separation in law between the levels of criminal damage, only in sentencing guidelines.

The offence still might not be a CIMT though. A lot depends on the consulate's view of the entire circumstances, including the applicant's explanation for what happened as well as what the outcome in law was.

It’s an L1 Visa. Thanks for all the info. It is really early days so I think we need to just go along with it and see what happens and have as much info available as we can so we know what to do and how to prepare for it if and when it becomes a problem.

Now might be a good time for him to have an honest discussion with them if this is going to cause a delay. It's a courtesy, if nothing else. The company are going to be investing a lot of time and money in him for this, not just the visa process but also his relocation package.

He will do - it’s still very early days he is still waiting to hear from HR about salary and relocation package. If that’s all ok he will tell them.

Put me in the probably won't need a waiver camp. These are very fact dependent. Even if it were a CIMT (far from certain), there is also the single petty offense exception. How many indictable offenses end in cautions....
