It's not unusual for companies, especially larger ones, to have a policy that you have to have worked for them for a certain time before they'll start a GC application. However, three years sounds a long time; iirc my employer back then had a one year rule before they would start an application, and you had to stay employed for a year after receipt of the GC to avoid being liable for the legal costs they incurred.

We had to go through one "review cycle" to make sure I "met" or "exceeded expectations" in our day to day work. I was lucky. I arrived in June 2012 and met the criteria to be "reviewed" in March. Green card application started later that year.

It's really up to the company.

Perhaps because arguing with an attorney over the precise meaning of a particular statement is rarely worth it unless you are another attorney who is being paid to do so ...

Doesn't all employment-based immigration involve an I-140 (cf. I-130 for all family-based)? To the best of my knowledge, this doesn't require the person being petitioned to be in the US. Once the the petition is approved, it is the next step (AOS or IV) that will be affected by their location.

I wasn't asking her to argue with him... just to ask him for proof before she assumes that she's automatically wrong. The point? One doesn't need to look farther than DC to draw some comparisons.
