Hi all
I have a question. I'm American and I'm married to an Irishman. We are living in Canada b/c my husband was denied a green card. He was granted a travel visa after he filed a waiver of inadmissiblity for 5 years. We went to Boston last year no problems. However, my husband got thrown in the drunk tank on St Paddy Day in Canada but was never fingerprinted, photographed or charged. Nor did he have to pay any fines. We want to drive to the US for T-giving. Does the US have anyway of finding this out if we dont tell them or will he get denied entry?

Having already been denied, you must assume that they probably DO know about the incident.

Even if not, no-one on this board is going to advise you to lie. If you get found out, then you've blown any chance of living in, or even visiting, the US for a very long time and possibly even forever!

This happened in March he got his waiver of inadmissiblity last year. He wasn't charged w/anything so I'm wondering if we wouldn't volunteer the information, but thank you.

To enter the US he would need to apply for the I94 waiver either online at this link
https://i94.cbp.dhs.gov/I94/#/home#section

or turning up at the Port Of Entry and applying. The cost of the !94 is $6 USD.

As for the incident in Canada I would be reading very closely any questions to be answered regarding arrests/charges or convictions as this is the question that catches people out or forces them to lie to gain entry.

Many people are arrested but never charged or convicted of offences. US law is different to Canadian law but an arrest with no charges or convictions would not bar a person being admitted into Canada.

He already has been granted a waiver last year before this incident happened. His waiver is good for 5 years.

And i spoke with an attorney the drunk tank is as meaningless as a traffic ticket and he was never even fined. But thanks. We will not say anything.
