Well, if somehow, you are in the "under process" void, you have a 7 day
window. They appropriate a visa number for a file under process; if they
can't adjudicate in your favor within those 7 days, they have to return the
number... but I think you are a couple months behind.. you should originally
have been processed only in late September; so you arent losing anything...
note that by issuing 4 times the usual monthly number of GCs in june, they
have moved a lot of cases from July, Aug etc, into June. So, buck up.. it is
the status quo for you

Is it possible that once quota is available (Oct. 2007) all visas will go in
2-3 days? I am reffering to I-485 applications and simmilar situation that
happened with H1-Bs.

who knows They may, they may not, they may retrogress the whole thing. My plane is to have everything ready to go mid September and see what the October visa bulletin brings. Although that could be pretty meaningless given what they did with the bulletin this month:curse:

and of course the cynic in me will not comment on the fact that application costs will go up to over a $1000 per application in this 'dead' period. The whole thing sucks and blows big time

Just had an email from our lawyers and they are expecting some retrogression in Oct, but only a few months:curse:

(Lets hope a few months doesn't drag into years..or lets hope she's wrong)

Hi everyone, new member here. I stumbled across this thread whilst desperately searching for news and it was comforting to find other people going through the same crap, so I thought I'd join. I just cant believe this has happened, the whole thing is just so stupid. My company had my EB2 app ready to go (got PERM), but I feel like they were being kind of slow with it and now....its too late! Its so frustrating and seems pretty unprecedented, which also makes me (and I'm sure everyone else) feel very unlucky (why now?!!).

Anyway, I don't have much to add I suppose, but I do have a question....how will retrogression work exactly in our case? Will priority dates now become important and if so, how will that work, since everybody was current up until, well, now?

My fear, as already said, is that now that they are not accepting any new applications they will work on the applications that they already have in the system. Then come October 1st all those applications will get approved and we'll have begun the cycle just as in the case for the H1B's.

If your fortunate enough to get through that's all fine and dandy, but if your name check takes a little longer then you'll be out of luck.

Don't really know what else can be said, but I think that there's a lot of people waiting to see what's going to happen on October 1st.

I am directly affected by the USCIS's stupidity in opening up all dates. I am ready to file now for my 485, but because of tehir stupidity I now have to wait till October and who knows what goal posts we will be shooting at then.

My numbers have always been current as I am English and have a PD of Feb 03, this is absolutely rubbish, these people are utterly without any sense.

Well I know that now past precedence is nothing to go by, but hopefully when the new fiscal year starts they'll put the limits back on the number of people per country and if that's the case England hopefully should be current again.

What I wonder is if your i485 was accepted when the date was current and then in October they move the dates back, what happens to your application?

To be honest I'd be surprised if anyone knows.

My PD was sep 2003 so it became current on June 1st and i mailed my adjustment of status in on June 4th. How does the "now you see them, now you don't" July 2nd conjuring trick affect people who have already filed applications?

Bonus question for the panel. What about the EAD my wife applied for at the same time is that affected?
