Never been to US & New H1B petition filed for transfer of existing visa,Is it Legal ?
Greetings !!!
I hold a valid H1B from Company A, but as i was never called to US, i
quit them 2 years ago, im still in my home country and have never been to US ever.
As my visa is still valid, company B has filed an H1B petition for me, but
has selected for "transfer" instead of "new employment" while making the application and has also mentioned my previous petition number in the filed petition.
My concern is will this petition be approved ?, as no paystubs have been attached with the application which has been made for a transfer.
I hope in case it is approved i need not go for stamping again, as my visa is still valid.
Please note that i have no paystubs as i never worked in US.
Is this legal. They have given me the receipt number after filing in March. Can i travel with the new petition ...which was filed as a transfer withouth havin worked in US ???
Any response would be much appreciated.
