Hi

I have a question about the waiver of ineligibility process.

I applied for a Visa at the Embassy as I have a criminal record.
I was declined but told that I could apply for a waiver of ineligibility from DHS.
I was then granted a 1-year visa with multiple visits.
I didn't use the visa (and it has now expired) as I missed the holiday I had booked due to the application time (around 6 months).

I would now like to apply again as I would like to travel to the US.

I know I have to apply for a visa again, which is fine. My question is about the waiver I was granted. Is the waiver permanent and separate to the visa which has an expiry date? Or is it one and the same thing?

I guess I am trying to ask whether I have to do the full end to end process again (e.g apply for a visa, get declined, go to DHS, get a visa) or will the Embassy now be able to grant me a visa without having to go through DHS?

you will go through the exact same process. Apply for visa, get recommended for waiver, wait 6+ months for waiver approval, get visa (this time might be valid longer than 1 year, maybe not).

There used to be an indefinite 212(d)(3) waiver. Some people received a Form I-185 card to document it. They stopped issuing indefinite waivers like 15 years ago though. Some people still have them. Unfortunately, the maximum validity period is now 60 months.
