L1b Visa holder looking to attain GC
Hi Guys,
I am currently working in NYC on an L1b visa and have 2 years remaining. I am looking to obtain my Green Card through my employment. I am not married, but my employer is willing to sponsor me on the basis that I provide the completed paper work myself. Wondering if there have been any similar cases on here that you can direct me to,or a starting point on how to begin my application and the relevant forms required in a case like this?
Kind Regards,
Jon

Your employer has to decide which employment based classification, EB-1/2/3, you'd fall under. They then need to perform the recruitment, file the PERM (if EB-2/3), and then the I-140. These are their applications, you cannot complete them yourself. Once all that is done and the I-140 approved, you can then file the I-485 (adjustment of status form) yourself.

If you search the forum, you'll find my post documenting my L1b-Greencard timeline.
Assuming you would be EB2 or EB3 - there is a LOT of work for the employer to do, as there is a labor certification step (PERM) that requires them to attempt to recruit for the role etc.

It has to be performed in the employers name, but, in theory at least the OP could complete the actual paperwork for the employer to sign and file.
That said, I fear in this case the employer thinks he will have to sign a few pieces of paper and write a check, which isn't even close to how it works for an L-1B -> green card.

Linked to this, are there any figures available that show how likely it would be that "Specialised Knowledge" that qualifies for the L-1B visa would also be sufficient to meet the EB-3 classification?

Every case is different. An average or overall percentage isn't going to help the OP at all.

Major red flag here. Like Pulaski said, it sounds like your employer will be hoping to sign paperwork and sign a check - however the paperwork required equates to a small section of the Amazon rainforest if it's like mine - financial statements (which you can't get unless you work high in the finance department), HR statements which you can't get unless you're in HR etc. And lots and lots of evidence related to your role and how you are specialized - this is not just a statement - I'm assuming you saw what was required for your L-1B - imagine that but MUST be exactly required for EB-2/3.
