Also, if you get a cap exempt H1B then you can get concurrent employment at any H1B

So it appears that the potential employer is not cap exempt (They didn't know themselves until consulting two lawyers)

However, they want to discuss the possibility of a consulting role until the H1B rolls around again . This will mean relocating back to the UK, as originally planned. I know I can keep a US bank account open and pay tax blah blah, so I'm assuming that I can still be paid in dollars?

I already have a UK HSBC, so I would simply open a US HSBC to use favorable transfer rates.

I think that you'll find the transfer rates better with Transferwise.

Rates may be better, but I'm pretty sure when they were trying to sell it to me originally they said they said there would be no fees (as long as it was under x amount)

You can be paid in almost anything, it's irrelevant. The question is how you fill in the HMRC tax forms.

Anyway, going back to post #60, they didn't even get as far as doing H-1B so like I said, E-2 is an option.

You've got two companies there you could consult for, so meeting the "it's not a subsistence job" requirement would be relatively easy and the "substantial" investment thing isn't usually a major problem. Especially when you start looking at house prices in the UK.

So, this came out of left field. Potential employer asked if I would consult with an Immigration Lawyer to see if there were any routes forward. Said Lawyer had reviewed my resume and decided that there is a case for an O-1, which he confirmed after our frank conversation

I'm a glass half full guy, so I hadn't considered it, however when he went through what 'might' be required and asked if I could get it, I found the answers were mostly yes or probably.

So now I wait to see if the potential employer will sponsor....
