Default I824 form

Anybody got experience with this?

Would like to opt for consular processing of NIW rather than file for I485 as would give more time in the UK to deal with tying up personal stuff there

Just wondered if this is viable or not?

If it helps I824 is a form when want to change where final processing of immigrant process is done i.e consular vs change of status

just wondered if anyone had experience with this

What is your current situation? Are you in the US on a non-immigrant work visa? If so, what are your plans to be in the UK (weeks/months)?

I know for consular processing you will have to be in the UK to attend the interview, but I'm afraid that's about the extent of my knowledge. I don't know if there is a requirement to be present in the UK beyond that.

There are a huge number of posts about the I-824 process over in the marriage-based visa forum. Many posters in the immi forum have experience of both, so hopefully someone will be along to comment soon. The more info you can give (and the more specific questions you can ask) the better.

am on H1 plan to go back to the UK next year for a good while am no rush to come back I dont think the I824 used for marriage is similar purpose to mine its a very generic form that can be used for a multitude of things afaik


Sorry i think you are confusing I824 with the I864 in marriage forum they are different

The I-824 is for action on an approved petition - it doesn't matter if it is family-based or employment-based. It seems to be far more common for family-based cases to follow the IV route than employment-based ones, so you will probably find more information in the marriage-based visa forum.

Maybe when I glanced at the page for relevant threads, but I was thinking of the right form . I would start by having a good search over there (or here for that matter).

Posting more specific questions might also improve your chances of a response.
