Default E2 Visa Process

Hi All,

So, I am looking at going down the E2 visa route. I live in the UK.

My background is IT and Construction. I am looking at starting a Home Technology Company specialising in Home technology products (ie CCTV, Alarms, Smart Lighting, Home Networks, Smart Heating Controls) etc. I would also avail my services to businesses where I cold maintain there computer networks, phone systems etc

I have approx $100,000 to invest and would be starting a business up rather than purchasing an existing business.

I am looking at doing the application for the E2 myself and looking at what needs to be done. I see such things such as...

Develop a Business Plan
Register a company
Setup a Bank Account
Lease Business Premises
Hire and accountant
File for the E2
Attend e2 Interview in London
Create a website and advertise
Rent a house
Move to the US with my wife and 3 kids

In what order should these things be done ? From my understanding a lot of these things should be done before filing for an E2.

What concerns me is starting up a company, hiring business premises, hiring an accountant, moving $100,000 to the US and then being denied for an E2.

You won't be moving to the US until you have your E-2. You could, however, be denied a renewal.

I'm fairly sure you don't need to actually act upon the business plan before being granted the visa.

Sounds to me like a huge undertaking for someone not trained or licenced in the US codes.

Please ensure you have a safety net back in the U.K. If the business fails, you will have to leave the country rapidly.

$100,000 is at the low end of the scale for investment for an E-2.

I presume that you have at least as much again to set up your family, covering initial expenses and deposits, living on while you get the business up and generating cash flow, and for contingencies.

You need the business plan before you can apply for the visa, so that is a big priority. You can escrow the funds for leasing premises — you need to show you have the funds to accomplish what you say you intend to do.
