Do I admit defeat? E2 & B1 Declined (214b)
Hi All,
Last November I applied for an E2 Visa to help integrate our systems for our recent acquisition within the U.S. This got denied due to not being able to prove that I am a specialist worker (even though I technically am with my 3 years experience here in London). We then come up with the plan to continue to work for the London company but to apply for a B1 for 6 weeks which would start up the systems in the U.S and then I would return to continue business as usual in London. Unfortunately this got declined last week under Section (214b) not being able to prove home ties? Is the only way to get my B1 now is to get a mortgage/rental property and possibly achieve a degree over the next year or two?
I'm 22, no degree but experienced in my field within this company. I have a professional job to come back to and all expenses of my trip were going to be paid by the company in London.
Do I admit defeat? I'm also worried that a B2 would now get refused If I were to go on holiday to the U.S next year?

The problem you have is an E2 denial, B1 denial and ESTA denial tagged on you, within four months
I am unsure how long you would need to wait before a future application.
Applying again this year will likely look you are trying to hard

Visa denials do not mean you can't use the VWP in the future. Next year fill out an ESTA and see what happens.
I don't see any way for you to work in the USA in the near future, though.

Thank you both for your responses, It sounds like I will need to give it at least a year to try my ESTA again and possibly then apply for my B2 if the ESTA is denied again.
Can anyone provide me with some clarification in regards to section 214(b) And what I can do in a years time which will increase my chances of getting a B1 approved? Sounds like I need to provide some serious home ties. (Mortgage etc)

What does your company have to say about all this? They apparently want you to be in the US, but you are the one racking up all the denials on your record. Have they consulted an attorney?

I do this job for the Northern neighbours (Canada) and we albeit have different rules we think somewhat the same regarding strong ties to a country.
In no particular order
1. Full time employment and how long for regardless of how many employers.
2. Mortgage where applicable if not have they rented or just living in mum and dads basement although from what I can remember the UK doesn't have a lot of basements.
3. Do they have a vehicle be it purchased or on lease?
4. Bank accounts how long and have they secured loans in the past and have good credit history.
5. What is the make up of the family and are they close?
Im sure there are others besides the usual return ticket, length of stay being requested and any criminal convictions.
