I felt that reading that having to read that lousy article was torture. It was a jumbled mess of holes. It sounds like she still doesn't know what her issue was and she really should have found out before sharing. It appears to start with her living in the US, returning to live some more and all she had was a pending application. When seeking to enter, a pending application is most often a liability.

I further explained that my current work visa application had been complicated due to a filing mistake and that I had been waiting on a decision... I denied this, citing that I run a legitimate nonprofit organization based in the U.S...

Wow, if there was ever an argument for having a basic understanding of the rules of the system under which you're trying to live, this is pretty much it. From the above, it sounds like they gave her a minimal amount of rope and she promptly hanged herself.

Sounds like she was paroled in to wrap her affairs up. She may be eligible for the VWP, interesting to see what happens with ESTA.

They could have done a VWP Refusal and then paroled her to depart on her own. I agree that there is no such thing as a 1 year bar these days. Many years ago an immigration judge could remove someone with a 1 year bar, but those days are long gone.
