OK, here's a little hypotehtical teaser some of you might enjoy...
Permanent resident gets arrested on a minor misdemeanor charge. Judge considers the arrest
wrongful, dismisses the case and orders the arrest documents, prints and photos destroyed.
No FBI file is created.
5 years later the PR applies for citizenship and needlessly, stupidly, lies about the
arrest (thinking it will save him the effort of explaining what had happened). However he
is extremely unlucky gets found out because of a residual computer record at the local
police department that the INS decides to investigate.
PR is consequently denied the requested benefit, e.g. Citizenship.
Questions:
1. Would he lose his PR status as well?
2. Could he apply again for Citizenship?
