But as of the end of this month that allocation disappears and I have to wait til April to submit? I am in early discussions with a hedge fund admin company in Charlotte and have indicated that I wouldn't be available til next October which I'm trying to pass off as a positive for them as they can't justify a hire right now but as the hedge fund markets are bouncing back, by next year they may be desperate.

To summarize, the follow up issue is described as follows.
As we now still have 19,000 FY 2010 H-1B cap-subject visas left it is conceivable there will be unused FY 2010 cap-subject visas remaining on March 31, 2010.
In that event, do those numbers roll over into FY 2011 thereby increasing the overall number of FY 2011 cap-subject visas available as of October 1, 2010?
Or, will there be a period of time beginning on April 1, 2010 where we will be able to apply for both the (then) presently available FY 2010 H-1B cap-subject visas (for work to begin anywhere from April 1, 2010 all the way through to September 30, 2010) as well as FY 2011 H-1B cap-subject visas to begin on October 1, 2010?

That is a very good question. I believe at the very least you will be able to apply for your FY2010 cap-subject H-1B up to March 31, 2010. As to the period between April 1, 2010 and September 30, 2010, I am researching the issue. I'll post here when I know more.

Until I hear otherwise from USCIS (e.g., that they are rolling over FY 2010 visas into FY 2011 numbers), my position is that we will continue to apply for FY 2010 H-1B cap-subject visas to begin work anywhere from October 1, 2009 through September 30, 2010.
