CBP can operate border checkpoints and conduct warrantless searches within 100 miles of the border, while a dog sniff is not even considered to be a search. Their initial stop was probably legal, but their handling of the stop could get them into trouble.

This was an interior check, never left the US, she did handover her DL and then it went downhill.

Who in their right mind speaks to a border patrol officer like that? She was aggressive and rude..IMO she knew exactly what she was doing behaving like that...even recorded it. We don't know what happened when she started shouting...whether she was assaulted or not.

She didn't break any laws by telling off the CBP agent. (Not the most sensible thing to do, but not a crime.)

IMO, the male CBP agent really blew it when he said that she was free to go but that the car wasn't. If he had "reasonable suspicion" to stop her, then he surely would not want to release her. That would suggest that he knew that he was detaining her without cause, and that isn't permitted.

I have never seen a check point like this in WA state, they are all over California and AZ though, but have yet to see one in WA along the border.

I'd imagine they do though since they do elsewhere, but never had any issues with the border people, they are always for the most part pleasant and polite.

The video is obviously limited, but it doesn't exactly bolster the case for using force against her. She was irritating, she wasn't pretty enough to get away with it and CBP went into authoritarian mode.
