It's a loss if the sale price is less than the purchase price on the escritura.

The official market value, not that it is relevant here, is calculated by Hacienda based on the cadastral value multiplied by a factor which depends on the municipality it is located in.

Our solicitors insisted we pay the Plusvalia tax and then had to claim it back. When we refused saying it was deemed unnecessary and illegal as we sold at a loss, we were told the house sale could not take place without us paying this money. So we paid. As our solicitors did a total hatchet job on our sale we subsequently sacked them and now need someone “who knows what they are doing” to get it back for us. We have been quoted €200 + 21% Tax PLUS 20% of what we paid €3000, so it ends up costing us circa €1000 of our initial illegal PlusValia tax payment. It’s an absolute disgrace.
