friends of ours who own a bar locally have been trying without success to find out if their 'canvas retractable 3 walls + roof' terrace cover, which they pull out to the front of their bar, counts as 'more than 2 walls + roof'


they haven't yet had a straight answer from any of the 'authorities' they have asked

no-one has been able to definitively say if the 'walls' only count if they are solid & permanent

If you read through the BOE I gave a link to it states: " A efectos de esta Ley, en el ámbito de la hostelería, se entiende por espacio al aire libre todo espacio no cubierto o todo espacio que estando cubierto esté rodeado lateralmente por un máximo de dos paredes, muros o paramentos.»
Dos. Se añade un nuevo apartado 7 al artículo 3, que queda redactado del siguiente modo:"

In the Spanish news they say any wall is classed as a wall, whether it is permanent, temporary, brick or canvas.

They used an example of one of those terrace awnings they put out in some cities over the winter time, to say it is now illegal to smoke in there.

Seems like it is, and that seems logical really, plastic walls will hold smoke in the same as a brick wall.

El Vagón, situada en la Plaza Alta, entra en el marco de la prohibición por unos metros de lona y plástico. Tiene mesas en el exterior, pero cubiertas por un toldo y según la ley, se considera recinto cerrado ya que está cerrado por tres de sus cuatro lados.

The trouble with the "authorities" is that they did not know what the law stated until the 30th Dec, as this was when the BOE was published. After that was basically public holiday time. They have had no time to study what has been published, that could be why they do not know what is what.

I haven't seen the spanish news - my very elderly dad is staying & sits chuntering every time we switch over to the spanish tele

I wonder how many bars have invested in these awnings thinking there'd be somewhere warm/dry for their smokers to go?

Because this was in the original draft law that was drawn up 3-6 months ago

The law was only passed a few weeks ago, so there was a possibility of some last minute ammendments. Thankfully, there weren't any

Well, I went in two bars last night for the Fiesta. In both of them people were smoking as normal.

People say that our village has special permission because of the Fiesta starting on January 2nd. Don't know how true this is.

I'll let you know how it is once the Fiesta has finished.

Well no body smoking in the restaurant we went to for lunch yesterday and all ashtrays had been removed to outside. Fantastic not having to walk through the normal fog in the bar area.
