Default Denuncias - what action to take?

I have an elderly friend who is resident in Spain. She denounced her neighbour last year for 'unreasonable noise' due to ongoing building works and one of the people pushing her when she was on his property complaining.
He has now denounced her back and the hearing is in March.
She is elderly, not in good health and very little money to pay for legal help.
Please can anyone advise as to what steps she would be advised to take before and at the hearing.
Thank you for any help.
Carolla

Hi Carolla and welcome to BE

The Welcome Inn is where new members say hi and get any orientation they need. You can try our Spain forum to get other members' suggestions about your question, but please remember that we're just a community of ordinary folk who have emigrated to other countries and are unable to give legal advice. Click here for Spain (the forum, not the country!) Spain - British Expats

Please have a read of the BE site rules when you get a minute.

It sounds like a very distressing time for your friend, I do hope the situation gets resolved.

Why did she consider the noise of construction to be unreasonable? Construction can be a noisy business. Unless there was use of noisy machinery in the evening or on weekends, I am not sure that she has much to complain about.

And she had trespassed onto the construction site when she was aledgedly "pushed"?

Simple, your friend must see a Solicitor. This will turn into a stressful nightmare for you all otherwise, you and your elderly friend just do not need it, this is life shortening, worrying and stressful stuff. It's escalated, and may continue to do so unless they get a proper grip on things. Can they handle Spanish Courts, processes and language? You know it makes sense, eh?
