475 Visa to PR??

Default 475 Visa to PR??

Can anyone help???

Here is our situation:

Paul - Primary Holder of 475 Visa (Carpenter)
Cathy - Secondary Applicant on the 475 Visa (RN)

Paul is a Sub-Contractor and moves from job to job on a regular basis as work is not all that stable at the present time.

Our main concern is Paul gaining the 12 months work needed to obtain the 887 Visa. We can apply for our 887 Visa in October 2011, I know we may be worrying prematurely, but we need to plan ahead and make sure we have everything in place as we do not want to leave Australia.

Some weeks he works 35 hrs, some 50 hrs. Can these hours be added together to accumulate in to weeks?? Or is it irrelevant if he goes over the 35 hrs in one week?

Regarding work references. Does he need to get references from every person/company he has worked for?? Or would 3-4 references suffice?

Our other question is. Could Cathy apply for the 887 Visa as the Main Applicant, as she has been in Full Time Employment for over 12 Months?? However, she has had no Skills Assessment carried out as she did not require one at the time of applying for the 475 Visa.

It does sound like it would be difficult for Paul to collate all the necessary evidence and it is not possible to average out hours worked. The work needs to be full time every week and extra hours worked in a particular week cannot be carried forward to another week.

If you review the eligibility requirements in the below link it does indicate that the secondary applicant on the 475 visa can be the main applicant on the 887 visa application. There is no reference to a skills assessment requirement for this visa.

Additional hours over 35 Hrs/ wk cannot be accumulated or carry forwarded. Since 475 visa allows you to stay in the country for 3 years you can also extend for one more year to meet the criteria. So in my opinion, meeting the 35 hrs/wk criteria for 54 weeks in 4 years would not pose any problem.

Yes, Cathy can be the main applicant for 887 if she meets the criteria. Skill assessment to be done for her if she applies as the main applicant.

There is nothing in the eligibility to say she needs a skills assessment.

I'm pretty sure that Cathy doesn't need a skill assessment.
Even also the required and most important documents are your Tax Returns for the last year and the pay slips if you have any. We didn't have any payslips as we are self employed and we didn't have any references from our customers at all. We received our 887 visa within 11 days from submitting the application
Best of luck for you two You will get it. We were very worried as well as we have our own business, we work from at home so very unsure how to show that we work full time but I think the most important for them is that you earn enough to be able to live here.
If Cathy or even you work full time so you won't have any problems with the visa.
