From 1 January, applicants for onshore general skilled migration visas claiming trade skills assessments will require specific "job ready" assessments. This is the specification, announced this morning:

This Specification provides occupations required to provide a skills assessment dated on or after 1 January 2010 to support amendments to the Migration Regulations 1994 made to ensure the job readiness of onshore applicants nominating trade occupations and that offshore applicants applying for the specified occupations be excluded from meeting the Australian study requirement.

The explanatory memorandum for these changes is as follows. The critical inference for offshore applicants is that henceforth trades skills assessed applicants will need to show relevant work experience in the assessed trade. If currently working in a supervisor trade you would need to be assessed as a supervisor. Provisions relevant to offshore applicants in bold:


EXPLANATORY STATEMENT
Migration Regulations 1994

SKILLED OCCUPATIONS FOR SKILLS ASSESSMENTS

(SUBPARAGRAPHS 1136(3)(bb)(ii), 1229(3)(ab)(ii) AND SUBCLAUSES 175.211(1), 176.211(1) AND 475.211(1))

1. This Instrument is made under subparagraphs 1136(3)(bb)(ii), 1229(3)(ab)(ii) and subclauses 175.211(1), 176.211(1) and 475.211(1) of the Migration Regulations 1994 (“the Regulations”).
2. Paragraph 1136(3)(bb) provides that if the applicant is not seeking to satisfy the criteria for the grant of a Subclass 887 (Skilled – Regional) visa and has nominated a skilled occupation specified by the Minister is an instrument in writing for this paragraph, the applicant’s skills must have been assessed by the relevant assessing authority, on or after 1 January 2010, as suitable for the applicant’s nominated skilled occupation.
3. Paragraph 1229(3)(ab) provides that, if an applicant is not seeking to satisfy the criteria for the grant of a Subclass 485 (Skilled - Graduate) visa and has nominated a skilled occupation specified by the Minister in an instrument in writing for this paragraph, then the applicant’s skills must have been assessed by the relevant assessing authority, on or after 1 January 2010, as suitable for the applicant’s nominated skilled occupation.
4. Subclauses 175.211(1), 176.211(1) and 475.211(1) provide that, if an applicant has nominated a skilled occupation, which is specified in an instrument in writing for the purposes of the above subclauses, the applicant has been employed in the skilled occupation for at least 12 months in the period of 24 months ending immediately before the day on which the application was made.
5. The purpose of the Instrument is to specify occupations required to provide a skills assessment dated on or after 1 January 2010 to support amendments to the Regulations made to ensure the job readiness of onshore applicants nominating trade occupations. It also provides that offshore applicants applying for the specified occupations be excluded from meeting the Australian study requirement.

6. Consultation was undertaken with the Department of Education, Employment and Workplace Relations (DEEWR).
7. The Instrument, IMMI 09/143, applies in relation to an application for a visa made on or after 1 January 2010.

I just looked at the TRA website for the job ready test info. I am freaked out by this. It is a money making scheme! It will cost 4550$!!!!! That's just for your assessment! You still have to shell out the money for your visa application, medicals, police checks etc! And you cannot apply for PR straight out of school anymore. You need 12 months full time paid work experience in order to pass the job ready test. So you don't have a choice but to get the graduate visa. Good luck with this everyone. Not sure how I'm gonna cope. And it's unclear now if you need 900 hours work experience or not. It seems a little vague. That is part of the provisional skills assessment. It says relevant experience over a period of at least 6 months. But no specification as to how many hours.

How much does it cost?
The total cost of participating in the Job Ready Program is AUD $4550.00. Payment is required at different stages of the Job Ready Program as set out below:


Step 1 Provisional Skills Assessment AUD $300.00
Step 2 Job Ready Employment AUD $750.00
Additional Training AUS $1,200.00*

To say I am anoyed at this is an understatement. They are claiming they have done this because students have struggled to find 900 hours of work, but then they are insisting that you have to find an employer who will register with them, give you a contract (they all seem reluctant to do that in my profession as it is a bit seasonal), AND have TRA people wandering around the work place by the looks of it a couple of times at least!!!
What an absolute joke! Merry bloody Christmas TRA!

Yup.. exactly my thoughts. Not sure what I'll do now. Plus a fee that used to be 300$ to get thru now costs 4550$ and an extra year. I hope they change their minds about this like they did when they said the 900 hours had to be paid. Anyone know where we can complain? I mean the fees are crazy! And I don't think I need an english course or an Australian culture course. I am from a class 1 country. Wait and see I guess. I won't be applying until next year anyway.

Well the first part I am ready to apply for now.
I am a little worried about convincing my employer to put me on a contract and agree to register with TRA and have them swarmping all over the place, at least twice by the looks of it, and filling in regular forms by the looks of it.

I am certainly planning to make a complaint, but not totally sure who to make it to?????

Like you say, the English and Australian culture bit, I know when it is smoko to have a tea break, what else do I need to know? And each sentiance now includes an f word, surly that should be enough?

I had no idea it was going to be as structured, lengthy and as expensive as that!! Fingers crossed it doesn't get put through!!

oh god. this is not good news for us.

Can anyone clarify something;

Hubby will be 44 when course finishes. He goes onto a graduate visa as we apply for PR. Does the PR application need to be in before he's 45 or is it different with him being on a graduate visa?

I am not sure I am wording this properly.

ie 44 when course finishes in August 2011, goes onto graduate visa (which would appear to have to be for 12 months given what's been said above). Husband is 45 in January but the 12 months won't be up until August when he's 45.5 - could he therefore be too late?

Do we start packing the boxes for the UK now

I think you have to be 45 or under..... so as long as he can get the work in pretty much asap he should be fine. I really don't think they have taken into account just how this will affect a lot of people.
Check the website to make sure for the 885 visa though.

We'd be applying for an 886 visa as sponsored by family.

If under 45 when PR application goes in we're stuffed as he won't meet all of this new criteria until he's 45 and a half. Bollocks.

I'm affraid it says you must be under 45 years of age at time of application. Any chance he can find someone to sponsor him?

Scrap that last bit, just noticed:
You must be under 45 years of age on the day of making your application.

Exception: You do not need to meet the age requirement if you are a holder of a Skilled - Graduate visa (subclass 485).

So although it says you don't need to be under 45 if going from the 485 (which we will all have to from now on), it doesn't seem to have taken into account the points you WOULD have got being 44. So you would have had 15 points for being 44, but over 44 it doesn't list any points.... hopefully you will still have enough to make it.
