Default I-751 Filed 9/03 with TSC, Recieved letter today ..WTF!!!!! HELP!!/ Crossposted

"Hub" is a conditional permanent resident which is valid for 2yrs. US.
immigration requires to apply to remove the conditional status we do
so 90 days before the expiration date of those 2 years, not before,
not after those 90 days.
i cant even get into the list of what we were required to send in
along with the application fee of 145.$ but it was 3 years worth of
"proof of a bonafide marriage" (yes EVERYTHING imaginable, we arent
stupid).
That was mailed via priority mail with return reciept, yadda yadda, to
the government on Sept 10, 2003. to the Texas service center as
required. The waiting time for this last part of immigration took
appr. one year.
One dang year to wait so some immigration officer in the midwest can
decide if we are reeeally married OR just got married so a person can
stay in the states.

Today we "finally" got a response in the mail NOT what we expected.
the letter states: "REQUEST FOR ADDITIONAL EVIDENCE" (we have now been
together going on 4 yrs in march)
"submit additional proof of a bona fide marriage such as financial
records (bank/credit card statements), life/health insurance records,
tax returns, vehicle/home purchase records, military documents,
leases, and/ or mortgages showing your name and your spouses name
together. The documentation you submit should cover the period from
the date of your marriage (3-16-01) to the present date.
we have 12 weeks to submit such evidence or deportation proceedings
will commence.
I am floored.
everything they are requesting we ((ALREADY SENT)) with our
application 1 year ago!!! Did they ^%$#! lose it all????
ya know what? we did everything by the book and sent tons and tons of
evidence!!! Now we have to resend it all and wait......?????
Im an American and if i could id move OUT of this country, but for my
UK hub most likely being banned for 10 years for us NOT completeing
THIS last bit of our immigration journey!!!
ok..im off to get a tranquilizer and sob.
ps, YES our AOS was approved, ages ago in Portland Maine.

Hi:

You've gotten notice they are processing the case -- you got a standard RFE -- respond. You just might get an approval back.

If you want, you ARE within your rights to request that they adjudicate on what they have already. If it was my case I would respond with "I am providing a copy of what was submitted previously in case it was lost. Also enclosed please find update information.

"We are painfully cognizant of the tremendous workloads the CIS is burdened with. We hope our case will be adjudicted in short area. Thank you for your courtesy and cooperation."

Bottom line -- you want an approval and honey gets a DAO to say "yes." Kiss ass and smile while doing so.

It is really simple....just do what they ask. Take a couple of records from
each year sine 3/16/01 and make copies and send them in. Include copies of
tax returns also. You may have already sent these in, but for whatever
reason they want them again now!

Don't stress about it..assuming you made copies of what you sent
before...make more copies and add anything pertinent. We sent in a copy of
plane tickets and pictures showing we took a family vacation. Add anything
you think might help. If you have any children be sure to send a copy of the
birth certificate.

I think most of us who have gone through this process have faced these type
of frustrations at some time...you are not alone.

Sorry for the frivolus reply here, but I just had to say that you crack me up, Mr. F.

I suppose getting an RFE might feel like a blow to one's case when one is doing their first and only I-751 case, but as I hope the OP is getting from the other replies it's really not the end of the case (world) and is a challenge you should be able to meet with a little thoughtful preparation. We're in the same boat. Only we submitted the I-751 to TSC in June of 2003.
Then we got the request for additional information only in June of this
year. We responded with more evidence. The request is misnamed. It should
really be the "please give us more time because we're up to our asses in
work here" request. Anyway, my wife has the I-551 stamp and can travel if
she likes.

God i hope so because i thought THIS part would be the breeze after
everything else, thanks so much for the input you guys...keeping
fingers crossed here (oh and yes we have copies)...send it all
certified with a signed return reciept right?
...im all for the kiss my ass part!! you know way back at our AOS
interview the lady asked if we had had sex together??? OMG...lmao to
which my UK hub responded "OH YEAA!" enthusiaticly. ugh

...thanks - i think, can you put this in moreso simple language for
me? Of course we freaked, being how we'd never had this happen before
(RFE) and the request is for everything we already submitted, i do
need to add here that my UK hub was cosponsored originally and i went
thru bankruptcy (filed prior to meeting my UK hub and ect). it was
discharged in 2003 hence most bills we have are only in my UK hubs
name as my credit now sucks. should i incude a copy of my BR discharge
(which sounds pretty crazy and is in my previous married name) to
explain why our utilities and 2 credit cards are in just his name?
input people please....and a thankyou.

We filed the I-751 with TSC in Nov 02 (that's right, 2002 !)
and haven't gotten an RFE or approval yet.

This week, we did get a letter about fingerprints for the
naturalization application.

ROFL! You are reminding me of a marriage fraud interview I attened 20 years ago. The question about sex is about as far as they can go. The pettioner in that case was originally from Brazil. And the investigator was quite careful in going into the sexual area [the old "Stokes" injunction is still in place]. So he asked "Did you and your husband consumate your relationship before you got married?" Client goes "What??". Investigator [not DAO], repeats the question. Same response. Well, the injunction applied to the government, not me. So I interject "Marian, he wants to know if you two slept together before you married." She got a Mona Lisa smile on her face and responded "Oh yes! Many times. Do you want to know how many?"

That investigator turned beet red. I wish I had had a video record for that one.


BTW, there is one BIA case on that question from 1968 where the parties did NOT sleep together. The petitioner had health problems, needed a housekeeper, she was willing, and they liked each other. The BIA stated there was no fraud and their reasons for getting married were "better than most." That is one of the few BIA decisions I actually laugh when I read it.

thanks...but did you read my response to another poster up aways? i
filed chapter 7 before being married or even meeting my Uk hub, it
finished after we were married...even after the AOS which is why most
bills are now in my UK hubs name, it was discharged in 6/03...should i
send a copy of the discharge and a brief summary that this is why most
bills are not in my name (utils, credit cards), all else is
joint..leases, bank accounts = crap we already sent. im shocked
because we sent alot too including cards sent to us, photos, ect ect.
the only thing we have new since then is 2003 tax filing copy and
another joint bank account...thats about it with both names on it.
*stumped* ... doesnt seem like a great idea to me sending a chapter 7
discharge, i dunno.
thoughts please?

Still waiting on a reply after sending more evidence in early July. (poetic
structure not intended)
