Alvena: Can she work?
I had posted this before, but I didn't get the expected results.
We went for our AOS in Miami on February 14th and waited all day long just to file
our papers. Unfortunately, their computer system had gone down and we couldn't get
any receipts for anything. Among other things we applied for her EAD (I-765) as a
renewal since she was allowed to work for 90 days when she entered via JFK airport. I
thought we would receive authorization in the mail when their computers came back up.
We just received our various receipts, and we got a notice to appear for the EAD on
May 13th with all our documentation, etc.
Does this mean she cannot work until then?

Firstly the one year EAD is not technically a renewal, it is a new EAD application.
I'm sure that Miami aren't going to be concerned about that, however. Secondly, she
cannot work between the date that her 90 day EAD expired and her full EAD is granted.
Since they are just within the 90 days they are allowed to process the EAD there is
little you can do about this - some offices have responded to requests to expedite it
but many have not.

Andy,
Thanks for your reply. When I was in Miami, I went with two versions of the form, one
as a "renewal" and one as a new request to work. I asked the examiner which one was
appropriate. The examiner told me that since we had a previous EAD at the port of
entry, this was considered a renewal. So that is the version of the form I gave them.

The examiner was incorrect. Not an unusual state for an INS employee to be in.
Your wife did NOT apply for that EAD and it is not renewable. The EAD she is applying for is technically her first EAD.

Re: Renewal
It will be interesting to see if they actually process it as a renewal or not. When
you renew an EAD, your new EAD starts at the end of the previous EAD. If they do
that, your wife will end up losing significant amounts of time since her EAD will
start a lot sooner than she gets it!
