I130 timeliine overseas?

Default I130 timeliine overseas?

Is there such a thing as a timeline for the I130 once it goes overseas?

Being that I am having to have my wife do our spouse visa overseas
because of our own error I am wondering how long this process is going
to take?

Where did you file the I-130? US? or the consulate abroad?

Origially I filed my I130 here in the US. Took 2 years and that is
only because it was at TSC and it was forwarded to NSC.
We did k3 visa while waiting which was a relief but not we are
stressed again because my wife went back to Manila to visit her mom and
didnt realize that the k3 was expired. We had already filed for AOS.
Now today I filed the fee for the AOS for the case number to be
processed overseas. This is why I am wondering if anyone knows about
how long it takes to get overseas.
We have been apart since July 31 this year. She was supposed to have
flown back Aug 19 and had a surprise bday party for me Aug 20. My bday
was Aug 17.

Oh my!! John I am so sorry to hear that!
It is hard to tell how long it will take, First it has to be forward to NVC (National Visa Center) then to the US consulate abroad.
Approved I-130's take longer to clear NVC than I-129's.. Look for posts of Cindyabs, she got her I-130 approved about 2 months ago.
I wish I could give you a timeline but unfortunately I can't

2-3 months is what I am looking at. You said Cindyabs got hers in 2
months. This gives me an outlook. My wife doesnt want it to take a year
and neither do I. I know someone who helped a couple other couple to do
the same and he said it would be 2-3 months. In the meantime I have the
papework for when we filed AOS with the I864. I will recopy that now so
i is ready to go when NVC contacts me.

I just wanted to get an idea of how it might be for the prcoess to go
through.

Hey John,
No we didn't get it IN two months, it got approved and off to NVC two months ago. We got the 864 several weeks ago to fill out, once that's acknowledged the case goes to London.

Please note that for the 65 bucks for fingerprinting AND for the 335 bucks for the visa fee those are paid by either money orders or cashiers checks-NO personal checks. I will say NVC has been very good about getting on with each step.

I am wondering of filing our adjustment of Status and then abandoning
it will make a huge differnce for our case. We didnt doit
intentionally but the govt may see otherwise.

The lady at the USCIS told me that being that it is abandonment of AOS
then we will have to file the I130 all over again from the beginning.
According to the timeline of TSC that would be nearly 1 1/2 years.
They are on 5-12-03 right now. It took them 2 years to originally to
do it and then they forwarded it to Nebraska. Apparently they were doing
some kind of stuff for Mexicans and the processing dates were stuck for
about 4 long months.
This lady also said we probably would not be eligible for a k3 either.
I can only hope she is dead wrong.

IN any case I will be going with my mom to Orlando USCIS thursday simply
to ask questions about this and get answers from different people in
person. I cant fathom the though about being away from her for
thatlong. Our 3 anniversary is Dec 15.

John I've been looking at your case a while now, and here's my 2 cents since I applied for my K3 in the Phils too...

The curious thing is, the US Embassy in Manila just sent me snail mail in my address in Manila, stating that they sent me (snail) mail in July 2003, stating that I should have applied for an immigrant visa after the year of issuance of the letter. Now I don't know how this applies to your wife, but maybe you can ask her relatives if they received such a letter from the Embassy. I'm thinking, this letter is for the immigrant visa Consulate Processing. I'm not sure if this info is useful to you, but anyway I got my K-3 visa December 2002 (with approved I-130). There may be a slight chance that your wife's immigrant visa application is still valid... I wish you both all the best.

The only letter that did arrive at my wifes house in Manila was the
choice of agent letter. It arrived here as well. We had already sent
that thing in before but then I faxed it back to her to see and check
off the first box instead of the 2nd box like it was originally. Only
differnce between the 2 boxes is the first one acknowleges that she is
in Manila but mail to my address whereas the 2nd shows to mail it to
my addess because she is here.

It looks like it comes down to whether they will throw our case out
because of the AOS and make us file all over again. I can only hope
that they dont make us do that.

It was probably a good thing to have the immigrant visa done oversea.
I chose that over doing AOS in the States.

The I-130 was approved in Jan 2004. We weren't very swift at filing
the Affidavit of Support and form DS-230, so the whole package (I-130,
I-864, DS-230) didn't arrive at the US Embassy in Bangkok until
6/1/2004. The interview date was scheduled on 7/26/2004. Be very
careful, do not rely on the appointment letter. I was very lucky, I
checked the embassy website and saw my case number 13 days before the
interview date. The official appt letter didn't arrive until
7/24/2004 Texas time, which was 7/25/2004 Bangkok time. Had I not
seen my case number, I wouldn't have made it.

If you file I-864, DS-230 as soon as you get those forms in the mail,
you're looking at 3 months once the I-130 is approved. Other people
whose I-130 were approved at the same time as me (Case numbers only
one digit apart) got their interviews in mid April.

By the way, that's the timeline for the US Embassy in Bangkok. It was
a very easy interview. I was asked 2 questions. When I was told to
pick up my passport the next day, I wasn't sure I was approved. I was
totally expecting probing questions along the line of 'Where did you
meet your husband?', 'What is his birthday?'. None asked. I wasn't
even asked why he wasn't with me at the interview.

Our I-130 was approved in February (TSC). The NVC completed its review, and sent our file to the consulate on July 26. So, that was about 5 months (we had an RFE which added a couple of weeks). We have now been waiting over 6 months since approval, and are waiting to hear from the consulate...

Hey there John:

Why don't you call NVC and find out what's going on? (once you get the notification from NVC), Tell them that your wife left with an expired K3.. but her I-130 has been approved, she should be able to fisnish the I-130 processing in her home country!

I agree with this reply... If your AOS is considered abandoned when your wife left, then what reason is there not to continue the I-130? Did you call NVC yet?

I have some encouraging news. I called the USCIS 800 number. I tried
the 603 number 3x and couldnt speak to an operator.
The USCIS operator did some research on this thing and eventually
transferred me to an immigration office who basically did some research.
She then told me to File an I824 which tells the consulate to process
our approved I130 overseas tothe appropriate place. I made sure I
covered my bases with my questions even down to the point of producing
letters from my wifes jobs showing that she intended to come back.
So, I have printed out the forms and will send them out tommorrow
to get this ball rolling.
