Was denied entry, now waiting for K1 interview please help!!!!!!
hello everyone!!!
Have a few questions to the members who have been through the same
predicament or from anyone who can help. My fiance received our K1 NO2
approval recently, i'm now reveiwing all the documents i'll be needing
for the the interview. I came across with document DS 156 question
#29,#30 & #35 (If ever been to US, ever been issued visa & ever been
cancelled or revoked) my answer to all of those were yes, #38 Have u
ever been refused admission to the US by wilful
misrepresentation......? I'm worried coz I heve been to US,
incidentally met my fiance then I went back home, but last year when
I came to visit my him I was denied entry Under sec and I was given
212 (a)(7)(A):I and was given option to Withdraw my Application for
Admission w/c I took was sent back but I used my return tiket so at no
expense to the US govt. so my answer to that question I guess will be
yes. I'm just worried if that would post as an implication to K1
approval pls. help? thank to all!

The 212a7(A) means you had immigrant intent, and were not in
possession of a valid visa. Since receiving a K1 will allow you
permission to enter the US to get married, and you will be using your
visa for it's intended purposes, I see no adverse effects of your
refusal on your K1.
The question about misrepresentation... well were you travelling to
get married? Did you lie at the POE? That's willful misrepresentation.
One of my friends was refused on a 212 a 7 (A) because she didn't have
proper documention (read this to mean, proof of ties and proof of non-
immigrant intent). She'd never been to the US before, and had never
met her boyfriend personally (this was the first meeting). She was
refused because she couldn't prove ties and prove intent to return
home, so they labelled her 212 a 7 (A) and sent her back to Canada. It
happens, not as often as other refusals...
Answer the questions, and don't worry about it. If asked to explain,
just explain you went for a visit and couldn't prove ties (if that's
what happened), that kind of thing happens all the time. As long as
you didn't lie (at the time you were refused), you should be fine with
the K1.
