Hey everyone, I have been reading this forum for weeks now as we are about to start our spousal visa journey. This forum has been very helpful as I was and still is a bit clueless with immigration stuff. I am the US citizen and am ready to send off our I -130 package. This is what I have assembled, am I missing anything?

1. Form I-130- Petition For Alien Relative
2. G-325A-By U.S. Citizen
3. G-325A-By Alien Relative (Spouse)
4. Passport pictures of U.S Citizen and Alien Relative with names printed at the back
5. Copy of U.S. Citizen’s Birth Certificate and Passport
6. Copy of Alien’s Birth Certificate and Passport
7. Evidence of Our Bonafide Marriage
-Copy of certified marriage certificate
-Birth certificate of our son
-Our love story
-Affidavits affirmed by third parties
-Phone records
- Money transfer records
-Pictures of our union
-Evidence of travel to visit each other
9. Payment of $420 in a form of a money order

As my wife was only in the US for the marriage ceremony and we initially intended for me to immigrate to the UK, we do not have co mingled assets, but we hope this is sufficient.

The above items are the things I believe you do not need to include.

The items above that you are including to show a joint, comingled life together, do not prove that. So no need to include them.

What do you mean by this? Wedding photos? Don't bother... your marriage certificate proves you're married.

Thanks Rene and Ian, we have sent off the I-130 and hopefully this will be enough, if not we will cross that bridge when we come to it. We will be married two years in May 2013, in order to get the 10 year green card, what does my wife need to do? Should she make sure that her interview is after May 2013 or would she still qualify for the 10 year GC if she waited until after May to enter the US regardless of when the visa was issued since the visa is good for 6 months?

If the visa interview happens before your 2-year wedding anniversary, she will receive a CR-1 Immigrant Visa.

If the visa interview happens after your 2-year wedding anniversary, she will receive an IR-1 Immigrant Visa.

If she enters the USA using the CR-1 Immigrant Visa before your 2-year wedding anniversary, she will receive a 2-year green card and will need to remove conditions during the 90-day window just prior to the expiration of the 2-year green card.

If she enters the USA using the CR-1 Immigrant Visa after your 2-year wedding anniversary, she should mention politely to the US POE agent that she has now been married more than 2 years (and show the marriage certificate to prove it). The agent will process her as an IR-1 at that time and she will receive a 10-year green card.

If she enters the USA using an IR-1 visa already in her passport, then she'll get the 10-year green card.

All of these scenarios are valid and legal, and should be nothing for you to be concerned about. What I mean is, don't adjust her interview or entry to the USA around whether she'll get a 2-year or 10-year green card. Just enter when necessary and do a removal of conditions if required. It's not a big deal.
