I am not a Spanish resident but own a property in Spain. Having seen all the warnings that I shouldn't play the UK lottery from Spain, I registered on http://www.loteriasyapuestas.es with my Spanish address and I have been playing from there when I'm over here.

However, I've now received an email saying I have to have my identity confirmed before I can continue to play and one of the things they're asking for is my tax office (in Spain). I'm assuming everyone who plays online will get one.

Given I pay tax in the UK, I'm at a loss as to what I should do here. Does anyone know what the new rules are because I can't find out from their website (apparently they changed the goalposts last year)? Many thanks.

Hi, I was under the impression you could only play it in the country you are normally resident in. I know when I have tried to log on to my UK account when I am in in Spain it will not let me purchase tickets. Don't know if this helps you at all.

There was some confusion initially with the UK site given they were allowing people to play from non-UK countries but refusing to pay out any winnings !!!! Then they changed the UK website so you were prevented from playing if your computer wasn't in the UK after a big furore in the UK press.

However, the same rules didn't apply to the Spanish website. You could play Euromillions from Spain. Now, after 3 years!!, they're asking for confirmation of identity, which isn't quite the same thing as residency. Could be they're going the same way as the UK but they don't say so. Problem I've got is that I have money on my Spanish lottery account and now can't access it until I've proven I am who I say I am although why a tax office would do that I have no idea. I'm very suspicious given the new rules about taxing non-residents in Spain.

I'll write them an email and, hopefully, I'll get a reply but I won't hold my breath lol. If I can get clarification, then I'll post again.

IMHO - Isn't that because, as you own a property here, you MUST pay tax on the imputed rent on it? Consequently, you should have a tax number (NIE/NIF) and be submitting tax returns in Spain.

OR, should you be paying the imputed tax in UK

I pay the property taxes in Spain - they're deducted by standing order. The lottery site has my NIE number, I had to enter it when I frist signed-up. It's the name of the tax office that they're asking for.

As I don't spend that much time in Spain I'm not required, as a non-resident, to submit a Spanish tax return (or at least, that is what I was told when I bought my house).

I know that I need to register somewhere if I'm in Spain for 90 consecutive days or more now (recent change) and submit a tax return, but that doesn't apply in my case.

The crux of my question is "can a non-resident play the Euromillions lottery in Spain?".

I guess I'm going to have to talk to an abogado.

Dear Susan,

As you are aware, to play National Lottery games online you need to be a UK or Isle of Man resident and be physically located in the UK or Isle of Man when buying a ticket. If you play by Direct Debit, not only must you be physically located in the UK or Isle of Man when setting up your Direct Debit but also when making amendments to it, including buying additional tickets, or changing your numbers or payment details.

From 23rd April 2012, any player attempting to access their National Lottery Account from outside of the UK or Isle of Man will be prevented from doing so, as our location software will block any access.

Why are we implementing a block?

As operator of the UK National Lottery, Camelot clearly wants to pay out prizes where it can - and we don't want anyone to miss out on a prize because they haven't complied with the Rules. We're therefore always looking at ways we can improve the quality of information we give players. Although we give clear warnings about playing from overseas, we believe this change makes it even clearer and simpler for players.

In line with this, we have updated our Interactive Terms and Conditions to ensure they reflect this amendment - to cover that National Lottery players will now be prevented from accessing their National Lottery Account if our software detects that they are intending to play National Lottery games from any jurisdiction other than the UK or Isle of Man.

The situation in the UK is clear. However, the situation in Spain is not. We know we can't use the UK website from Spain but can we use the Spanish website from Spain when we're there?

I`d worry about that if I won , not before, small amounts can be collected from any ticket vendor , post it to a friend if you are not visiting the UK.

Seems to be a very grey area, after all why should they make the distinction between buying online or buying for instance when in the uk over the counter. If a Spaniard for example bought a ticket whilst on holiday in the UK he would be able to collect any winnings

May be there are tax implications with different countries so it suits them to make a blanket rule to cover non UK countries.

It sounds as though what you are paying by direct debit is the IBI tax (equivalent to Council Tax). In addition, however, people who own property in Spain but are not resident ARE obliged to submit an annual non-resident tax return (form 210) and pay tax on the notional rental income - 24% of 2% of the valor catastral of the property, or 1.1% of valor catastral for properties revalued after 1994. If you are speaking to an abogado, I suggest you check this out as it has been reported that Hacienda are tightening up on this and many other things and you might face a demand for back taxes if they catch up with you, even if you were badly advised at the time of purchase.
