Default Do I qualify for a British Passport

I am curious if I can apply for a British Citizen. My father was a British Citizen and migrated to Canada, he became a Canadian Citizen in 1972 but I don't think he denounced his British Citizenship. Anyways is it possible for me to apply for British Citizen through decent since I was born in 1978 in Canada.

Should be. My partner got British Citizenship through her dad being a scot (and he came out to Oz when he was 4!) So, unless they've changed all the rules you should be fine.

Was your father born in the UK?

You will need to fill in a UKM form which is downloadable together with the guide on how to do it
You need two referees,. one of them needs to be an over 25 British passport holder unrelated to referee number one ..but read the guide

The site is called UK Border Agency just like the north American services now

Well meaning but completely wrong advice ... UKM registration is for those born before 1983 with a British born mother, who are not British automatically but usually entitled to register as British.

Your father would only have lost British nationality if he went to the British consulate and signed forms renouncing it under British law. Statements to the Canadians, or even handing over a British passport, are irrelevant.

Assuming he stayed British, then read on.

If both of the following apply:

- your father was born in the United Kingdom, Channel Islands and Isle of Man,, AND
- your parents were married when you were born.

Then you are already a British citizen by descent.

If "no" to one of the above then more detail is required and you may not necessarily be British.

Actually, based on what you have posted on the other thread, it's not at all clear whether your father is a British citizen rather than a British Overseas Citizen.

Also, if he was born in the Kenya Protectorate rather than the Colony, he might not even be that. A lot more detail is needed.
