A H1B visa allows U.S. employers to temporarily employ foreign workers in specialty occupations.
The regulations define a “specialty occupation†as requiring theoretical and practical application of a body of highly specialized knowledge in a field of human endeavor including, but not limited to, architecture, engineering, mathematics, physical sciences, social sciences, biotechnology, medicine and health, education, law, accounting, business specialties, theology, and the arts, and requiring the attainment of a bachelor’s degree or its equivalent as a minimum.
Sales definately does not qualify.

He is going to be involved in the marketing of these products to distributors/retailers. He obviously has 'specialist knowledge' of what he will be selling but no more than a US born and bred salesman in that particular field.
This is why i initially asked the question as to if USCIS relax the criteria for applying if all the spaces aren't filled.

I won't argue with you there !
I know what you were saying in your earlier posts, and i wouldn't have believed it but he's already put a deposit down on a new house in Oklahoma (company is based in Edmund) so it's obviously true. His brother told me that USCIS didn't really have a problem with his application and it was pretty plain sailing.
There's no doubt that his application was probably been 'flowered up' somewhat but good luck to him. If i remember rightly (but could be mistaken), Ray had a friend who was over on an H1B and he was a BMW mechanic and he went to work for a BMW dealership in the US
At the time i was surprised at that one.
