Question Notarized Statutory Declaration - leaving a dependant child behind

I need to know if anyone has done a Notarized Statutory Declaration with their PR for a dependant child being left in the UK?

I am seeing a lawyer next Tuesday and he needs to know what to put in it. The website isn't very specific and only states:

NON-ACCOMPANYING FAMILY MEMBERS DECLARATION (IF APPLICABLE):
If you have a spouse, common-law partner or dependent children and you do not
intend to include them in your application for permanent residence, submit with your
application a notarized statutory declaration stating your intention to proceed to
Canada without your family members, and confirming that you understand that your
family members must meet immigration requirements in their own right if they wish
to join you in Canada
.

You've already got most of them. Just convert the above to "I".

Have you already done this then?

I don't want to shell out £175 to find out I've missed something.

I spoke with an Immigration Lawyer at one of the Emigrate Shows recently and he told me that my husband would have to get his ex-wife to relinquish any financial burden/responsibility to his daughter in order to emigrate, which of course she's not going to agree to!

Hi Bex,

Just wondering how you got on with the wording of your Stat Dec for leaving a dependant child behind. I'm in the exact same boat with my son, (17), and daughter, (13), staying behind with their mum.

I've full support from my ex-wife and the kids, just not clear on the correct wording around financial obligations etc...

Any help would be appreciated.

our statement included the fact that all child support payments are up to date and will continue to be met and that no arrears are due

also included a letter from CSA confirming this and the fact that child support payments are deducted at source from income


also mentioned in the statement that we relinquish all rights to sponsor now or at anytime in the future and that we fully understand the consequences of the children not being examined ( ie they wont be having meds)

huge luck all this is a right mare for anyone in this situation

we then got the stament notorised and both signed it me as principal applicant and husband as father

also note we were asked to provide birth certs for the kids easy to get you can order online and delivery from the uk to canada was about 10 days

it was also at this point that we realised sons date of birth wrong on application however had word back all is forgiven by CHC for this error woops!!
