That's not entirely correct. There are waivers available for most bans. Having said that, the waiver process is costly and complicated - with no guarantee of success.

An important point that should be made, is that it matters which district OP and her husband resides in. Some district offices have changed their policy on whether or not to allow AOS from the VWP.

This is another reason why a legal consultation is in order. A local immigration attorney should know what the policy for the local USCIS office is regarding AOS from VWP.
