Thanks Mazza, I'm crapping myself slightly at all the things that need to be organised before we go. But once we book our tickets there's no way out of it really!!

Yeah I know the feeling! I'm having some major wobbles about the whole move now cos our tickets are booked and it's gettin close. I keep telling myself that these feelings are natural and that it'll be worth it in the end

Girls and guys,
  • Is it necessary to sent spouse application AFTER spouse having PR move to Australia ? Or can it be done when spouse has PR but has not yet made the move to Australia?
  • also is possible to nominate an email for electronics communication for spouse visa

Hi All,

I'm in the process of completing form 47SP and have a few questions I wanted to ask.

I was refused leave to enter the UK some years ago as the immigration official was under the impression that I was coming back to the UK to look for work after having been over previously on a working holiday visa.

I was questioned for a number of hours and was then free to travel into London as I had medication on me that I needed to deliver to a friend. Immigration held my passport and I returned the same afternoon to catch an evening flight back to my then home country.

I've since been living in the UK for many years and am a British Citizen (I wasn't one at the time I was refused leave to enter). The immigration official did inform me that I was not subject to an exclusion period and could return to the UK any time, provided I applied for a tourist visa.

Question 5 states: Have you or any person included in this application ever had a visa cancelled? - Do I answer yes or no as technically I'd not applied for a visa; however my visa stamp in my passport was crossed out.

Question 80: been removed or deported from any
country (including Australia)? - I'd answer yes to this

been excluded from or asked to leave any
country (including Australia)? - Do I answer yes?

Some of the questions certainly are ambiguous and any guidance would be greatly appreciated.

You either had a visa which was crossed out or you didn't. If you did - how else did you get into the country - then you answer 'yes'

You were asked to leave the UK so the answer is 'yes'

There is nothing ambiguous about the questions. The answers are yes or no. You can always write an additional note explaining what happened and how you've since received Citizenship if you want to.

Thanks for the advice moneypenny. Just wanted to be extra sure and of course be truthful and honest when applying. I'll be sure to add an extra note giving an explanation.

As I've said to several people in the past, my forms were full of asterisks referring them to info on an additional sheet where I could properly explain my answer and little notes here there and everywhere Sometimes there isn't a clear yes/no answer but instead a "yes but...." I tried to keep in mind that the forms aren't there to catch you out or look for ways to refuse you, just merely seeking information. You have a good explanation for what happened and clearly it was all sorted out in the long run as you are now a british citizen, furthermore they trusted you to enter the country and do what needed to be done before flying out of the uk.

I was reading the declaration form 888 which is required to be filled by atleast 2 Australian citizen or PRs. And I found that the person who is providing this declaration MUST know both the partners.

Actually in my case, I have many Australian friends who know me... But they dont know my wife first hand. They do know that I am married to this women, but they have actually never met her ??

Can they still declare for me? Or is there any way around this ?

If you don't know any Australians you can get statements from other friends and family. The ideal is that they know both of you but often this isn't possible - in the case of a Prospective Marriage visa for sintance when the partners are living in different countries. So the way to deal with it is to get statements from family/friends of both partners, saying what they DO know. For instance when I applied for my Pros Marriage Visa my sister wrote a statement to say how much she was looking forward to meeting my fiance, and his family and friends in Aus wrote statements about how they were looking forward to getting to know me. Friends can write about how they know you keep in touch constantly by texts and emails, how you have talked about plans for the future, all that sort of thing.
DIAC don't expect the impossible, they just want you to provide what evidence you can

Hi All,

I wanted to find out if anyone had filled in the forms 47SP and 40SP electronically? When I open the Adobe version, it allows me to complete each of the fields and then print the forms out.

Has anyone heard of applicants completing the forms online and signing them or would DIAC have issues with this?

You can't apply for a Spouse Visa online. Paper applications only.

Oh you can do that. You never used to be able to, there was no fill option but if you now can then go for it.

Make sure you're using the most uptodate form and check they haven't produced a new one before you send the application off.
