Visa refusal and cancellation under section 501
Have been doing some research about my last query and if anybody is in the same boat they may find this of interest.
It basically outlines in more detail stuff about failing the character test - also describes under what situations DIMIA may apply leninecy etc. when considering a case.

We do two or three AAT cases a year in the area of character, and another
four or five at the primary stage, and I can confirm from experience that
character isn't an area for amateurs, unfortunately. The bottom line is
that you can research a lot of the accumulated law through www.aat.gov.au
and searching the decision database, but ultimately you need to be able to
survive either the primary character issue or the discretion issue, as
outlined in the Minister's Direction on s.501. As Jeremy said, the starting
point is that a suspended sentence is a sentence and yours brings you within
the danger area.
I am happy to advise about this, and as a general rule I would strongly
suggest that you do not mention details of your criminal history on this
newsgroup or any other public forum.
