Re: L1 Granted, but CIMT exists

Except that so-called "moral turpitude" has never been defined by statute, so it's really a matter of opinion. Which can never be resolved in any specific case, unless and until that matter were to...

Re: Changes to the Citizenship Act

Parliament chose to not to make any exception for those who are already PR. Not sure what basis such "legal challenge" could have. Contrary to popular myth, the courts are not there to act as an...

Re: Owning "foreign" stocks?

I thought this has come up before and the answer is that, based on facts submitted, it's a private company share investment, reportable on form 8938, and if you have no better indication of value you...

Re: Consequences of UK mortgage repayment whilst resident in USA

Read the earlier parts of the thread to understand the issue better, but you should perhaps understand that: a. if you were no longer US tax resident, it's not an issue, b. if it's part of a non-U.S....

Re: Investment Dliemmas?

Except that the IRS do not normally require this to defer gains in foreign pensions.

Re: L1 Granted, but CIMT exists

Is it? Are you sure?
A lot of things are stated with great confidence on forums without necessarily being true. Obviously, some categories of theft would be, but all of them, all the time?

Re: Godparent in USA, what happens if we die?

Except that most places do accept an out-of-jurisdiction will, as long as that will meets the local standards for validity.

Except that there's no such thing as "Aussie jurisdiction". Each...

Re: H1b and UK tax

Never heard of HMRC demanding any of these things to establish non-residence, and it would usually not be a good idea to surrender a U.K. driving licence, unless required by a foreign license...

Re: Owning "foreign" stocks?

It means what it says. If you hold the stock directly, and not through a brokerage account.

If you have a brokerage account, you report that and not the underlying stocks.
If you own the stock...

Re: Investment Dliemmas?

Form 8938 asks if you disposed of the relevant asset in the year.
And you must declare any capital gains resulting from the disposal (plus any income in 2014)

Correct - IF you have to file an...

Re: Godparent in USA, what happens if we die?

Instructions in a will are not legally binding, as far as I know, but may be taken into account by the courts.
Are your wife's cousin + husband U.S. citizens? They might have to adopt her in order...

Re: Green Card Holder Buy to Let Mortgage in the UK

So you go from having one paid-for property (in the U.K.) to having two properties, one paid for (in the U.S.) and one mortgaged (in the U.K.)

Why would you want to do that? And even if you did,...

Re: Green Card Holder Buy to Let Mortgage in the UK

That will be much harder once you are no longer a U.K. resident. Not necessarily impossible, but more difficult.

Pay a dollar in interest to save maybe 35 cents in taxes? Not a good...

Re: Problems with son's passport - can anyone help?

Since you are naturalised British, it would be strongly recommended to get your child a consular birth certificate. That acts as lifetime evidence of British citizenship, while a passport is not.

Re: Having a child in SA - British Parents

To ask what?

The law is quite clear that the child isn't going to be a South African citizen, so you are going to first get the child's birth certificate as normal, then get a British passport...

Re: British citizenship by descent question

I stand corrected. Section 3(2) registration requires that the child's grandparent was a British citizen when the parent was born (or a CUKC who became a British citizen in 1983).

The answer is...

Re: British citizenship by descent question

If you research the requirements for Section 3(2) you should find that your future child has a good chance of registration, based on the facts submitted.

So you then need to make a decision -...

Re: Renewing 2 child passports from the US

That's more likely in a jurisdiction with a real or perceived high risk of fraud. Less likely in the United States. Also, less likely for a renewal compared to a first passport application.

Re: In the US changing from Int. Company A (L1-A) to US Company B

It is. You should understand that unless they have had experience with the immigration system, most U.S. citizens know little or nothing about immigration laws.

In that case, you stay with...

Re: Immigration to US as an investor?

Re: Citizenship Application- Kids' education records

Except that there's no such thing as a "family application". Spouses always apply independently, and children are attached to the application of one parent or the other.

CIC do normally group...

Re: School Reports for citizenship application

They shouldn't do that if evidence of at least 3 years in Canada is provided. Read the Regulations. And in the unlikely event that they did, you would go back to them and tell them to follow their...

Re: British citizenship document

A late reply to this thread, but if someone acquired British citizenship automatically at birth, the birth certificates of the parents (plus marriage certificate, normally) should be sufficient...
