Re: Denial at entrance and subsequent B visa application

DOS often doesn't have the time or interest in reviewing the bulk of self-serving B1/B2 documents submitted. Does anyone think the note from the USC family member (who may have...

Re: Denial at entrance and subsequent B visa application

Due to the previous VWP refusal, the US government will never intentionally approve the ESTA or allow VWP travel. If for some reason the ESTA was approved it would be in error and would likely result...

Re: Denial at entrance and subsequent B visa application

Sounds like a VWP refusal. It's almost unheard of for a VWP traveler to be allowed to withdraw at an airport port of entry. They'd be withdrawing in lieu exercising the ability to have the matter...

Re: IN DESPERATE NEED OF HELP ON 221G

Hi. Just curious.... What type of "action" do you believe this person may be able to take in this matter?

Re: Chances of Entering the US after Small Class A Drug Possession Charge

The consulate likely wants to avoid all of the "am I inadmissible or can I use ESTA" emails. it's too complicated to figure out without a close look at the relevant documents and an interview. So...

Re: B1/B2 visa question

Non-use is probably a positive over never having one or having one refused. She didn't use it to move in when she had the chance.

Re: Chances of Entering the US after Small Class A Drug Possession Charge

I don't see a reason to seek an ESTA just to have it denied and then applying for a visa. He can just apply for the visa straight away.

Re: Petty offense exception

I agree. It's been described as "If you have a waiver, that means you must need a waiver." Getting a consular officer to CLOK something is a royal pain and the path of least resistance is often to...

Re: I-551 and re-entry

I believe the I-90 can be submitted online from anywhere, but the applicant must be in the U.S. for the biometrics.

Re: I-551 and re-entry

Yes. The reentry permit is valid as a standalone entry document even without having the actual I-551 card. However, bring it if you have it. Having both can help avoid confusion with the airline and...

Re: I-551 and re-entry

One small tweak to a very informative post....

The passport style reentry permit is normally valid for only 2 years.

Re: Petty offense exception

According to open sources, there is now a process that DOS can use to get DHS's 2 cents about an applicant during the DOS review process. It sounds similar to the advisory opinion process DOS has...

Re: Young worker refused - what are my options?

The training you describe along with the other factors would indicate that work authorization would be required to provide the training. There is a difference between attending training and...

Re: Young worker refused - what are my options?

There is a huge difference between what is allowed under E-2 vs/ B-1. You can perform work on the E-2, but can't perform work on a B-1 or ESTA. The consulate probably determined that the work you'd...

Re: F1 Visa advice please

Immediate relatives can apply for AOS from almost all nonimmigrant classifications (One exception a crewmember). The issue is that seeking entry as a nonimmigrant with the intention of AOS is...

Re: F1 Visa advice please

With an F-1 application from a non-traditional student with 14 visits to Houston in 3 years, the "visiting friends" claim will work perfectly... if the Consular Officer was hired through some new job...

Re: F1 Visa advice please

Hi,

F-1 students are generally required to prove the existence of an unrelinquished foreign domicile to which they intend to return upon the conclusion of their temporary purpose in the United...

Re: Revoking a visa

Make sure they admit/stamp you in on the VWP and not the E. They may CWOP it.

Re: Worried About My Conviction

Some convictions are just "what you see is what you get" and based on the offense/sentence. Some have wiggle room based on the elements of the offense. Another poster mentioned categorical and...

Re: Worried About My Conviction

I agree. Some pretty unsavory things aren't CIMT. Things like involuntary manslaughter may not be. Paying for the services of a prostitute may not be. Illegally possessing of a firearm. Some B&E,...

Re: Worried About My Conviction

I don't agree. Considering it's clearly a serious offense and complicated, I would want to make sure with the consulate and perhaps an attorney before commencing travel.

If he was...

Re: CIMT two questions

If someone is inadmissible for an adult CIMT conviction, that never goes away without a pardon. It could be 15 years or 100. It's a lifetime bar without a waiver. Waivers are usually easier to get...

Re: Crew Visa Help

There is often a 'crew booth' at larger airports. Miami has one. That crew booth is for airline crew. You would use the regular non-USC line. Each time you are coming to join a ship, you should...
