The significance of >180 days in the previous tax year is that it is a necessary though not sufficient requirement for being resident as per FEMA, which is necessary for you to hold a resident bank...

you are probably referring to FEMA, which makes no reference to foreigners or Indian citizens - only to residents and non-residents. There are thousands of posts on this...
