Can it be assumed then that you didn't disclose the CIMT when you applied for the ESTA. If that is the case the ESTA is invalid anyway and your lawyer should be careful what he/she says.

Do you notice that the word banned does not appear in what you quoted. You were deported and banned. It is the banned part which makes you ineligible to have a waiver, as long as the ban is in force.
