Re: Nonimmigrant Visa Waiver of Ineligibility Application

You'll be tied to your L-1 sponsor until you get an EAD (or your green card), but after that you can work for anyone you want... including yourself. Yes, you can apply for naturalization 3 years...

Re: Nonimmigrant Visa Waiver of Ineligibility Application

No - but since you're now in the US, why would you want to bother?

No, and no.

Oh dear god, why bother? They're not going to answer your questions or give you any advice.

Re: Nonimmigrant Visa Waiver of Ineligibility Application

There's a reason that we refer to it as the misinformation line.

Why have you assumed that they know? They're not the ones who send off the letter... they're simply 3rd party contractors who...

Re: Nonimmigrant Visa Waiver of Ineligibility Application

With respect, an immigration attorney can't change the past. Your husband has a drug conviction on record - and, while I understand that you're anxious about this, don't invest so much in getting the...

Re: Nonimmigrant Visa Waiver of Ineligibility Application

Just about everyone thinks this. You're barely 4.5 months into a 6-7 month process... so don't expect anything until mid-October at the earliest.

Re: Nonimmigrant Visa Waiver of Ineligibility Application

Perhaps you should start by reading the last hundred or so posts... your questions are all answered. It's called doing your own research and is ultimately more empowering than being spoon fed...

Re: Nonimmigrant Visa Waiver of Ineligibility Application

There's never been a guarantee. Now, however, they're able to give you a plausible reason... whether it's true or not. I think it's nothing more than scaremongering.

Re: Nonimmigrant Visa Waiver of Ineligibility Application

The web site, BritishExpats, doesn't just deal with the UK and the US. There are forums for many countries around the world. Perhaps the Canada Immigration forum would be suitable for your questions....

Re: Nonimmigrant Visa Waiver of Ineligibility Application

It's probably closer to 6-7 months, but yes - don't plan any travel until you have the visa in your passport. Well done.

Re: Nonimmigrant Visa Waiver of Ineligibility Application

No.

Waivers are currently taking 6-7 months for approval. Plan accordingly.

Correct.

Re: Nonimmigrant Visa Waiver of Ineligibility Application

Oh, my... yes!

It's time consuming - to be sure... but if you were recommended for a waiver, there's a 99.9% chance it'll be approved.

Re: Nonimmigrant Visa Waiver of Ineligibility Application

Of course not. If they wrote down a time frame on the paper, then they'd likely have to abide by it... which, to be honest, they really don't want to do. Once they recommend a waiver, the paperwork...

Outstanding! Well done.

You're very welcome. Sometimes, a bit of objective perspective helps to maintain focus during uncertain times.

Re: Nonimmigrant Visa Waiver of Ineligibility Application

If the officer said he would put the application forward for a waiver, then that is what happened. You've been told that the process will take 6-7 months... you're barely 1 week into that period......

Re: Nonimmigrant Visa Waiver of Ineligibility Application

Yes - it could take several weeks. That doesn't mean that it will... only that it could. Most people get their passport back within 2 weeks.

Yes... but...

... you will cause the...

Re: Nonimmigrant Visa Waiver of Ineligibility Application

Nonsense. He's creating an issue where none exists. The US has no interest whatsoever in when or where you travel. All that matters, is that you all have either a valid visa or valid ESTA. That said,...

Re: Nonimmigrant Visa Waiver of Ineligibility Application

You can't. You can only send it to them - by post or courier... you can't personally take it to them.

I don't think he did say that... because he can't.

Re: Nonimmigrant Visa Waiver of Ineligibility Application

Correct.

If you don't know what it is, you'll find out when you print it. :) Otherwise, the instructions seem pretty clear.

Maybe 2 weeks, give or take.

Re: Nonimmigrant Visa Waiver of Ineligibility Application

It's just a fancy term that means it's still in Administrative Processing. As I mentioned earlier - they can't say more than that because they don't know.

Generally, the application will always show refused up until the moment the waiver is approved... however long that takes.

There's really no way to know whether it's right or not. All I know...

Re: Nonimmigrant Visa Waiver of Ineligibility Application

To be fair, the average is 6 months... taken over, say, the last 5 years. There will always be applications that are processed faster for some reason, and others that are slower for some reason....
