The 6C is for fraud/misrepresentation, but if the 2A1 doesn't apply then 6C shouldn't either unless there is something else at play.

Was it a caution? How old were you when it happened? It's clear that it was determined that no waiver was required. They don't issue 10 year visas if there is a waiver needed.

The Gov of Texas can only pardon crimes from Texas. Foreign pardons are not recognized so if your crime was foreign, then a pardon would not alleviate your need for a waiver.

That is not always the case. Often the entire family will be go to secondary and the person may be questioned in front of family.

ICE Fugitive Ops likely had your case left to close. They check periodically on open cases. Perhaps they saw that you departed in 2004 and assumed the 10 years should start upon that departure...

They're supposed to refuse or issue within one business day even if still reviewing it. If they decide to issue later, they can change the refusal to issued/approved.

Very rough estimate would be 3 years from the time the sentence has been completed including all parole and/or probation. Of course applying really only risks...

They probably don't want to slow down the queue. Also, the waiver can be revoked at will for things such as additional arrests following waiver issuance so they may check for that.
