When she turns 21, she needs her own visa; she can not be a dependent on yours. She would be denied the renewal. This is common with virtually all of the non immigrant visas.

They can look up 'why' on their computer. Tell the truth. It was probably for not having strong ties to your home country, very common.

IV= Immigrant Visa.
IV petition = I-130 (family) or I-140 (employment)

It means that it is not predjudicial if the E-3 has an IV petition filed on his/her behalf.

I think it has always been OK for E-3s to adjust from that status directly. There may be timing of visa number availability or other factors that make people choose the H-1B-first route?

I have never, in close to ten years of following this forum and others, seen anyone post the same situation. If you are using a lawyer, they should be able to tell you if there is a legal bar to this...

What about her mother's E3D? If you two are not together, you're going to need permission from her to bring the child anyway... I don't have a link to back this up, but I think a 3rd country...

Maybe you should look into it further. It's my understanding that you can have German + another citizenship, but you must apply to the German gov't for permission first.

I think that was confusing, the way Ian wrote it.
Other people have done exactly what you propose. Come to the US, gain status, file EAD, do biometrics, leave until EAD is issued, return to US. ...

Yeah, I have my Qs about that too... the EAD requires biometrics (fingerprinting) too, doesn't it?
Maybe a trip for a few weeks instead?

Unfortunately, you can't do that. You aren't an E-3D until you arrive in the US.
You can submit your EAD application after arrival, but not before.
