I am surprised that given your experience of living in Portugal to date that you believe that it is as simple as you post.
There are for a start numerous regulations regarding the income source ( not pensions ), business type which qualify for thelower 20% tax rule etc etc.
I too have looked at various sites and have seen some which suggest the process can take 6 months , that full disclosure of assets and income is a prerequisite, nothing is assurred etc etc.
Once you are in the system haven given all the info the financas if you do not get NHR then you are of course liable for the full PT tax regime.
Plus of course the fees charged even if you do not get NHR.

Come along now, EMR - you know very well the Portuguese tax authorities don't require us to declare assets, no matter which regime we're being taxed under.

Oh this thread is VERY interesting for us: We both are now PT residents and bought a home near Tavira which is our primary residence. Our income is from a private Irish pension and maybe down the road from summer rental income and maybe further down the road from a business, but for the sake of this thread today, the sole income is a private (vs state pension) Irish Municipal Fireman's Pension, which is taxed smartly at source. Our first non-business trip to Portugal was January 2015.... so would we be eligible for the NHR, I wonder? Any thoughts out there before we pay for an experienced TAX accountant... it would be helpful if we were eligible for the NHR scheme.

My application is now in lisboa after sending it off yesterday thanks to TonyJ1.

He emailed me 2 letters to sign and send to the Diretor Geral Financas in Lisbon.

You will not have time to research and write the letters in Portuguese as the cut off day is this Tuesday. Get hold of Tony now and he will send the same letters to you today. In your case, you will save a tonne of money per year.

I believe eligibility is resident Portugal + having primary residence in Portugal + staying at least 183 days In Portugal + not having been taxed as a tax resident in Portugal in the previous 5 years. Good contact to start the ball rolling is Home - Fiscal & Expatriate Services in Portugal - Eurofinesco S.A.. You can have an initial discussion I'm sure.

Did you get sorted Munsterfan? If not, I highly recommend you do so asap as your private pension will be taxable here. Your Gov pension will still be taxed in the UK AND here.

Sorry UKRAM NOT TRUE.
Portugal has a number of dual taxation agreements with countries such as the UK.
If tax resident in Portugal you will be credited with any UK tax paid and pay any difference between tax paid and that due in Portugal.

I was able prove to the financas and was able to that I was paying tax in the UK on work I was doing for a Portuguese company.
It may take you time to satisfy and individual financas officer but the same could equally apply with the inland revenue in the UK.
It could be that down here in the south where there are many more of us there are more officials who speak English and who are more switched on to the rules and regs.

YOU DO NOT HAVE TO PAY THE TAX TWICE.

Some pensions cannot be exported free of tax and as such there is obviously no NHR benefit.

The UK Government has indicated in the past that it would change the rules on pensions regarding payment free of tax.

It is a well known fact that you do not PAY TAX TWICE as you say. The DTA between UK/PT is very simple as with most other countries.

DTA's are in place to assist people from paying tax in both countries.

I did not say you do. But you did in your post to Munsterman.?

He cannot be taxed on his government pension in two places at the full rate of tax.

He could however have to pay the difference between the tax already paid and the applicable PT tax rate.
That is not double taxation. The same would apply in the UK .

EMR what Ukkram said was "Your Gov pension will still be taxed in the UK AND here."

I think Ukkram meant that unless Munsterfan gets on the NHR scheme he will pay his UK tax in the UK and some tax in PT as it is higher there. Not that Munsterfan would pay full tax in both countries. As you say he'd pay the difference.

I'm pretty sure we all understand this concept.
