Re: Forest Fires
?? As it's via ECHR if they win, then, as far as I understand things, they can then apply to the ICC for some individual criminal prosecutions???
Naturally, I exclude the Confederate States of Britain where 'change' is a dirty word, as is air quality, and now fire regulations; - rather like General Sir Cecil Hogmanay Melchett's opinion of the word 'crevice'

Re: Forest Fires
Well what a surprise , a couple off weeks ago ,a Court in Braga sent a arsonist to Jail for 7 years off which HE has to sever @ least 3.5.
Then comes the "rub" ,this is the third time this guy been caught & sentenced ,but the two previous sentences off 3.5 years where suspended ?????????
I think I could my head around that the first sentence could have been suspended , but hell's teeth not the 2nd one.
If the PT System is at all serious about attempting to stop these criminal acts ,that cause massive damage & sometimes the loss off life , then send these bat -hit crazy individuals down the steps every time they get caught !

Re: Forest Fires
Having read so many discussions about this "law" so many time's & now't has ever been done over enforcing it, as usual in PT it's another case off "wait & see what happens"

It'll be interesting to see how many do time - then maybe the UK can copy it for those responsible for Grenfell Tower ....

Re: Forest Fires
After years the owner of the land behind us is finally cutting down the trees on our boundary..
Not just us but other neighbours pleased to see the fire risk reduced.

Re: Forest Fires
I got this letter about fines.
They seem to require that land owners do the following:
Clear vegetation, cut trees and mow tall grasses:
- Within a radius of 50 meters around houses, warehouses, workshops, factories or shipyards;
- Within a radius of 100 meters on land around villages, campsites, industrial parks, logistic platforms and landfills;
- Cut the tops of trees over 4 meters above the ground and keep them at least 4 meters apart;
- Cut all trees and shrubs within 5 meters of houses and prevent branches from growing on the roof;
What does 'cut' mean? Cut down completely? Or just trim? I mean, they cannot seriously be suggesting that ANY tree over 4m high needs to be cut down to 4m or lower, can they? Or that if you have two trees closer than 4m, then one of them needs to come down? Or that any tree or shrub within 5 metres of a house, even a small ornamental tree or plant, needs to be cut down?
I mean, we don't live in a forest, we live in a condominium south of Lisbon. There have been fires in the trees around this general area, but nothing within the condominium, and everything within is well watered and maintained. Do we really have to rip out our small olive tree that's maybe 3m from the house, or a couple of tipuanas in the garden, which are maybe 2m apart? Or pull out the hedges and shrubs from around the house?

Re: Forest Fires
I'm having the same thoughts; if taken literally, I have to kill my big palms and my entire fruit orchard, even though I'm located in the middle of a large area of flat empty agricultural land.
Perhaps something is lost in translation?
On top of that, they've said it all has to be done by March 15!
That's simply not possible.

Re: Forest Fires
The Portugal News supplement is the best information we have seen so far about the law and how to implement it. Previous information from other sources, including meetings with the Bombeiros in the Algarve, has been scant and unhelpful.
Yesterday, I visited the Moncarapacho fregusia and was given an A4 piece of paper with an unhelpful drawing purporting to show all the measures we needed to take around our rural property. When I explained that our land was a managed ornamental garden I was told that I had to remove all the trees, bushes and flowers within 50m of our house! Clearly this would be a disastrous step to take for any proud property owner but I also think I was misinformed. On reading the Portugal News supplement today, I believe I know what is needed - carry on managing my garden as normal. Thank you Safe Communities Algarve.

Re: Forest Fires
It seems a knee-jerk one size fits all instruction. For a house in a forested area, it would make perfect sense.
I'll also just do as I've always done; I'm actually one of the only landowners in the area who keeps his land clear of brush, so I hope they don't turn up and tell me to take out my forest, orchard, and the many other trees I care for.
