Our lawyer, has told us that a Portuguese will is unnecessary if we have our British will translated and authorised by the British Consul.

Does anyone know if this is correct and if there are any complications if there is no Portuguese will?

Also, our lawyer said that in Portugal, your estate is pre determined between your children and you can't for instance divide an estate between children and grand children, which our British will does, so we wonder how does this get treated in PT?

Any information would be greatly appreciated from you knowledgeable people out there.

For the sake of a few €`s its best to get it sorted, a UK will does not cover Spain, we need a Spanish will also, so I assume PT is the same.

I would tend to agree, but I'm told Portuguese wills are considerbaly more expensive than Spanish ones.

When we had a house in Menorca, our lawyer charged €50 each for our two wills, but I've heard, amounts of €300/€400 have been mentioned on some of the message boards for Portugal.

Also the pre-determined aspect if true, is not satisfactory from our point of view.

The other thing about a translated British will is what do they do if you have a "tenants in common" will? These have become more common as our Chancellor endeavours to take more and more in Inheritance Tax.

Ive been told it is essential to have a portuguese will.
Lots of various opinions,Ive heard stories about the Portuguese government taking the house if there is no will.
I have also been told that it is expensive,figures you quote are about right.
Uk wills are not acceptable here as far as I am aware,although with new EU regs coming in all the time..........who knows.
Many processes are becoming easier here,for instance,Residencia,only 3 years ago,it was an expensive business,lots of red tape,proving money in the bank etc etc,now its 7 euros,a quick form to fill in,produce passport and fiscal,job done.
Friends of mine paid about 400 euros EACH a few years ago.

There are obviously lots of questions and probably even more possible answers.

The thing is, who do you ask to obtain a definitive answer, if that's possible.

I've been told by my Portugese lawyer that it's essential - what for I'm not entirely clear on. When I've closed out my property purchase I'll see what I have left and probably make a will.

But my point is that friends of mine who have bought property in Portugal have been charged €600 (late last year).

The consensus seems to be a will in Portugal is expensive.

What I need to confirm is whether our lawyer is correct about a translated British will being acceptable in Portugal, especially if it doesn't meet the Portuguese rules about beneficiaries, again assuming our lawyer is correct.

Nothing seems straight forward.
