UK stepson to US question......

Okay here goes....my Uk spouse just got his adjustment approved a few months ago (we
got married here and adjusted him)... next spring we would like for my 15 yr old UK
stepson to come out to live (he finishes school in May there) for a year....my
husband did list him somewhere in the AOS papers as being 'his son'..so what do we do
now to get things rolling here so he may come out?

You do not specify that he will be staying permanently, however if he probably will,
file an I-130 for him now. He qualifies as a "child" of the Us citizen, under

Oops sorry..he would be staying for either the summer or 1 year Alvena and as we all
know the "visa waiver" he would come over on usually is only good for 90 days. Also
he would like to work here while here (he is 16 in january).

There are no options for work other than a work visa or residency. He may change his
mind and decide to stay, however...do consider that. If you file an I-130 for him and
then he leaves, he has lost nothing. He could have another one filed for him in the
future, I think, if he ever changed his mind. However once he becomes a certain age,
that option will no longer exist. alvena

Okay i got that, but when he comes to visit can he stay and wait for the i-130 to
go through? anyone have any ideas how long it would take and where i would file
such a paper...? local INS or service center..we use VT as we are in mass., what
is the cost?
