Hi!
I'm a British citizen who's been living in the USA the last 2.5 years. I'm married to an American citizen and we are looking to move back to the uk.
He has secured a job offer in the uk, for salaried employment. We are confused about which visa is best to apply for, spousal or work? And what tier?
Any info would be much appreciated.

Depends on your circumstances and wishes.

If your husband's prospective employer is willing and able to sponsor him for a Tier 2 (General) visa then this would lead to settlement and citizenship in five years' time but it would be necessary for your husband to work for his employer for the whole five year period unless he was able to find another UK company willing to sponsor and employ him.

A spouse visa would give your husband the flexibility to work for whomever he wishes (or not at all) but there are financial requirements for you as the sponsor to meet which are quite onerous and it would be more expensive for you personally in terms of visa fees. Again settlement and citizenship is available after five years.

It's the employer who applies for the work visa (usually Tier 2).

If the employer has not agreed to obtain a work visa for your husband then, you, the British spouse, must sponsor him

You must apply for a settlement visa for him:

You must fulfill financial, relationship and accommodation criteria.

In summary you either have to be earning 18,600 per annum or have savings, pensions etc to make up shortfall.

Your husband's income does not count.

If my kids already have British citizenship , are they still required to be included in the calculation or do I just include my spouse?
