What is my 'official' status?

Default What is my 'official' status?

Hi all,

I first entered as an F1 and long story short I met someone. We are now married and have filed the AOS documents.

Am I correct in saying that my F1 status is now null and void? What is my official status whilst I await my PR?

Pending adjustment of status. That is the status. As long as you don't violate the provisions of being a Pending PR, i.e. commit a crime, leave the country without an advance parole and remain marriage, you have the right to the same privileges of an adjusted permanent resident until the adjudication of your petition.

... but I completely disagree with this. He does not have those same rights and the fact that he even needs advance parole or needs to stay married is prima facie proof that he has no such rights.

You're right, but here is my take on it. I was thinking that he has the right to live and work in the US (which is a privilege of PR status) while the petition is pending. He can open bank accounts, obtain credit, rent an apartment, etc., legally. These are all the privileges of a PR. The only privilege not accorded him is possession of the green card.
