??? Walk in EAD

??? Walk in EAD
We sent AOS package on 10/06/03, we received 3 NOA's in the post and our checks cleared on the 14th. We don't know if we will be receiving the "little yellow receipt".
So can we use the NOA we received to do a walk-in EAD at Federal Plaza, in New York.
My 90 day EAD expires on Monday, October 20, 2003 and we were thinking of camping out on the 22 or the 23.
Any suggestions or advice would be greatly appreciated.

If I understand you correctly - no, you cannot do a walk-in on the
22nd or 23rd.
You can do a walk-in 90 days after the 'received' date in the top left
corner of your NOA. Assuming that this date would be on or around 14th
Oct, the date your checks cleared, that puts you in mid-January
territory, I'm afraid.
Incidentally, does your case number begin with MSC-xxxxxxxxxx? Were
you asked to book a biometrics appointment?

Hi C

'Fraid so.
The 90 day rule simply means that BCIS *should* process all EAD
applications within 90 days of receipt. If they don't then you have
the right to walk in after 90 days and demand an *interim* EAD the
same day.
Of course NY has the extra limitation that they will only process 50
or 100 (or however many it is) walk-in interim EADs per day.
You ought to have filed AOS/EAD/AP the nano-second you got married, in
order to get your EAD ASAP. If it's any consolation, the MSC number
means your application was forwarded to the National Benefits Center
for processing. They're pretty good about processing EADs. I got mine
less than 90 days after applying, thus saving me the miserable
experience of lining up outside Federal Plaza at 11pm the night before
in order to obtain one of those coveted 50 or 100 places.
If it's any further consolation, your AOS application was also sent to
NBC. This means you have a shot at getting your Green Card much sooner
than the 2+ years that NY BCIS generally takes.
Cheers,
Marco
18 months and counting for AOS at NYC BCIS.... still a ways to go!
