Sorry everyone for these silly questions. Its all new to me and my situation got complicated by my UK visa renewal process. Yes I have my original birth certificate and a copy of my passport and my UK visa that just expired on Nov 28th 2013.

How does the "UK visa renewal process" affect your filing an I-130 for your spouse? It's not like the two processes are related in any way.

You are right its not related.But the way I think of it is since my passport is with them and in case I need to send it with the DCF application like I had to for my UK spouse visa then I would be in trouble. Secondly I thought that I have to show them constant prove that I am allowed to stay here as UKC spouse and if my visa expired back in Nov 28th and the UKBA still didn't send my passport with a visa extension I though that would affect our DCF application . Hopefully its not too confusing.
