Military Spouse visa refusal

Re: Military Spouse visa refusal
You don't need an attorney in the UK, and as immigration is a federal matter, a lawyer could be anywhere in the US. .... You should be able to deal with everything over the phone and by email/ fax/ snailmail/ courier. Just make sure you find a lawyer experienced in handling waivers.
If you could find one experienced in military spouse visas that might be a plus too. .... Try looking near major US military bases - and they should be cheaper than lawyers in New York or another major city.

You may have already done this but I would be surprised if the JAG office you initially went to cannot help with your paperwork now you have a reason. Also, remember if and when mitigating to highlight that the US military has previously run a background check on you (that is what you said?).

D/L both the form and the instructions and have a read of what is needed from you and your husband. I went over the instructions briefly for you and is room for you to elaborate on your crime. Also it mentions hardship needs to be proven. It is not hardship for you, the foreign spouse, but hardship to the USC. It is 13 pages so don't go crazy !!

If one of those contacts was J Craig Fong, then you're in a good place. If none of them were J Craig Fong, then you can safely ignore the rest and start with him.

Re: Military Spouse visa refusal
So received an official refusal letter this morning saying that I am refused under section 212(a)(2)(a)(1)
And that I may be eligible for a waiver
my husband has extended his time here until November. Do you advise we get an attorney to help us now? And is there any chance of getting this expedited?
Thank you

As you know, I think that J is one of God's gift to the planet. But there are quite a few competent immigration attorneys in the Golden State.
I provided OP with a name of a recognized expert in waivers. However, in order to provide top service, and protect her own sanity, Laurel keeps tight control on her work flow. So, she sometimes will close the door to new cases.

Re: Military Spouse visa refusal
I'm hoping to bump the thread and maybe get some further advice if this is normal and I know I should maybe be patient but I feel it's wasting time. It is 3 weeks now since the CEAC status tracker changed to refused and I still haven't had anything back from the embassy. I had a letter on the 17th in response to an email I sent which explained the refusal as I stated earlier and that's it. They still have my passport and documents. I am no further forward. I have tried calling the NVC to see if they know anything but they say I'm in administrative processing which I still don't get as the visa is refused. I am so tired and stressed and not knowing what's happening is really frustrating.

The only thing I can suggest is getting an immigration lawyer involved, as they have contacts at the embassy that laymen don't.
