Hi folks I'm British ciziten and currently living in london and thinking of moving over to US on a green card. I'm considering marrying my fianance later on this year. We spoke with a U.S immigration lawyer and he suggested that I enter the country on an ESTA and stay for a month and then apply for an Ajustment of Status to allow me to file for residency. I would just like some advice on here is this a good option?

  • US Citizen can apply for a special visa to allow a non-citizen (their fiancĂ©e) to enter the country in order to get married to a US citizen inside the US. Once issued, the K1 visa will allow the non-citizen to enter the United States legally, for 90 days in order for the marriage ceremony to take place. Once you marry, the non-citizen can remain in the US and may apply for permanent residence. While USCIS processes the application, the non-citizen can remain in the US legally The US citizen income must meet the require minimum to fulfill the affidavit of support currently $20300 for a 2 person household

I certainly hope you weren't charged for this awful advice! I'm sure a mod will move this thread to the marriage-based forum, where some experts will be along to help you, but in the meantime, your options are to enter the US on a fiance visa or a spouse visa. The green card comes later. Entering on the VWP with the intent to remain in the US is illegal.

If you don't already hold a green card, you can't move to the USA on a green card. You first need some kind of visa.

Perfect! You can either get a K-1 fiancé visa (allowing you to enter the USA, get married, and then file for adjustment of status...green card), or marry first and then return to the UK for CR-1 spouse immigrant visa processing.

This is VERY bad advice. It's illegal to misrepresent yourself as a tourist if your true intent is to remain and adjust status. If the AOS is denied, you can be banned from the USA forever. It's better to do one of the marriage based visas and have no regrets.

The OP is only 23 (approx) and has just quit college on his F1.

If he goes down this route of getting married he should be aware that his fiance has to sponsor him and that the K-1 route takes approx 8 to 10 months (approx) to process. Then when he gets the K1 visa he enters the US, gets married and THEN applies for Adjustment of Status.

All these visas cost money .......

I was told by my college I've within 5 months to Reactive my Sevis and return back to the United States pending approval.

What does that mean? You intend to return to the USA on the F-1 and continue studying?

F-1 is not dual intent.
